He was serving a six-year sentence for fraudulently taking possession of premises in a departmental house, when it became known that a case had been opened against him for taking a bribe of 10 million rubles. for the patronage of manufacturers of uniforms for the fighters of the National Guard. And now they are planning to charge him with complicity in a scam when the same manufacturers supply products at inflated prices. According to the results of the examination, damage was caused by almost 400 million rubles. However, the defense insists on the absurdity of these conclusions, arguing that the markup did not exceed 1% and does not contradict the law.

On Wednesday, the chairman of the State Duma Committee on Information Policy Alexander Khinshtein, who at one time was an adviser to the head of the National Guard, announced new claims by investigators from the Main Military Investigation Directorate (GVSU) of the TFR against Sergei Mileiko. According to him, the former chief rear guard of the Russian Guard, deprived of the rank of general by the court, became a defendant in a criminal case on especially large-scale fraud (part 4 of article 159 of the Criminal Code of the Russian Federation). “We are talking about a large-scale scam organized by Mileiko and other then leaders of the National Guard. In 2017, they transferred all contracts for the supply of clothing to the small firm SpetsShveySnab (SShS), which was unable to fulfill even 1% of the volume. At the same time, prices were shamelessly inflated and did not match the quality,” Mr. Khinshtein said, noting that over two and a half years 134 contracts were concluded for more than 3.6 billion rubles.

With reference to the data of the investigation he explained that at least 10% of these funds were stolen, and the case file shows the amount of damage in 388 million rubles.

The parliamentarian emphasized that these facts were revealed back in 2019 during the inspections of the Main Directorate of the Security Service of the Russian Guard, appointed by the director Viktor Zolotov.

In turn, Sergey Mileiko’s lawyer Artem Vrublevsky told Kommersant that he learned about the alleged new criminal case of his client from Alexander Khinshtein’s message, and the investigators did not notify him of anything, although this is required by the Code of Criminal Procedure. The defender refused to talk about the position of his client, his state of health and whereabouts, citing the lack of permission from the principal. Meanwhile, Kommersant's informed sources reported that Sergei Mileiko had already been transferred to one of the capital's pre-trial detention centers from IK-5 of the general regime of Kirovo-Chepetsk, where former employees of courts and law enforcement agencies are kept. There he is serving almost a six-year sentence: as Kommersant told, the former general was found guilty of illegally taking possession of non-residential premises in a departmental house in Balashikha, near Moscow, turned by his wife into a beauty salon.

According to Kommersant, investigators from the GVSU of the TFR are planning to bring charges against the ex-deputy head of the Russian Guard, which is directly related to the high-profile investigation that has been going on for several years about the supply of allegedly low-quality uniforms for the soldiers of the Russian Guard by OOO SpetsShveySnab (SShS), which is part of the Magellan group of companies. “.

The main person involved in the fraud case is the head of the Civil Code, Igor Shalnov. As Kommersant reported, his enterprise, by government decree, was determined to be the only supplier of clothing support for the National Guard. According to investigators, hundreds of millions of damages were caused to the department during the implementation of 22 contracts. Mr. Shalnov, who categorically denied his guilt, was previously placed in a pre-trial detention center, but then released. According to preliminary information, the other day, the investigation obtained the results of a financial and economic examination, according to which many prices for deliveries “were not economically justified”, and there is an “overestimation of the price of the state contract” by a total of almost 400 million rubles. Together with the testimony obtained by the investigation from other defendants – according to Kommersant, in addition to witnesses, there are also suspects in the case, for example, a former accountant of the SSHS – this gives the SCSU an opportunity to formally charge Sergei Mileiko as a participant in fraud. According to Kommersant's sources, we are talking about initiating a new criminal case, since the old one does not mention officials. It will then be merged with the USS case.

By the way, indirect evidence of the interest of the then rear man in the scam may be his previous accusation of corruption. As Kommersant told, first on charges of taking a bribe of 10 million rubles. Colonel Nikolai Kopytov, former deputy head of the financial and economic department of the Russian Guard, was arrested from the leadership of the USS, whose activities were supervised by General Mileiko. The money was intended to allocate additional funding from the security forces for 2 billion rubles. And the final recipient of this amount was the ex-general Mileiko.

However, the defense of the USS leadership considers the experts' conclusions untenable. According to the lawyers, the first study, conducted by studying the market value of all clothing property for the needs of the Russian Guard, not only did not reveal an overpricing, but, on the contrary, showed its underestimation. They also note that the overstatement was discovered by the FAS as part of its study – by 61 million rubles, while other experts were already talking about 123 million. According to the USS, the maximum price that was indicated in the contracts was formed within the plans and established limits of the Russian Guard, and the mark-up did not exceed 1%, which is quite within the framework of the laws.

According to the defense, the new examination takes as a basis a certain “weighted average price”, which is unclear how there is no need to speak.

As an example, they cite the cost of a uniform set, which in 2019 was supplied on average for 4,600–4,700 rubles, while experts considered that it supposedly should have cost 1,800 rubles. However, according to the lawyers of the SSHS, in the same year, the Russian Guard also purchased such a uniform from another supplier – the Novoshakhtinsk garment factory – for exactly 4600-4700 rubles, but in this case there were no complaints and no. “The conclusions of the examination do not correspond to actual evidence, agreements and contracts, etc. have not been studied,” the lawyers summed up, calling it “absurd” the revision after two years of fixed prices set by the customer, based on his own funding limits. They also recalled that the quality of products was confirmed by the decisions of arbitration courts that rejected the claims of the National Guard for the replacement of goods. The defense does not exclude the activation of the investigation by a sharp increase in demand for a high-quality uniform of the Magellan Group of Companies, which proved its advantages under the conditions of a special operation. In addition, interest in the company's combat equipment was allegedly shown within the framework of the exhibition recently held at the All-Russian Exhibition Center, and the equipment is now being sent as humanitarian aid to the NVO zone, where it is being field tested.
