End of the TDSC era. Shpeter’s firm froze almost all construction projects
Recently, a story of the State Television and Radio Broadcasting Company “Tomsk” was released about the expanded meeting of the builders of the Tomsk region, which took place at TGASU.
The story told about how poorly TDSK OJSC (OGRN 1027000761040) works. The unfortunate company, you see, was besieged from all sides: people are indignant, permissions for the construction of certain objects are not given.
“During the seven months of this year, the company commissioned more than 52,000 square meters of housing <...> Now, according to the management, there are almost no groundwork for continuing housing projects for the company, since there are no permits for the construction of facilities in Tomsk and the Tomsk region. As a result of protracted litigation with supervisory authorities, large-scale housing projects with an investment volume of hundreds of billions of rubles have been frozen, ”the Tomsk State Television and Radio Broadcasting Company said in a story.
It also mentions a housing complex on Komsomolsky Avenue, which is allegedly the latest project of TDSK. A journalist from the State Television and Radio Broadcasting Company “Tomsk” describes it this way: “Three high-rise residential towers, a cozy courtyard without cars, a functional roof with exercise equipment and a hammock.” Well, a hammock is, indeed, a necessary thing, how can you rent a house without it, these are not parking lots that no one needs …
Recall that back in November 2022, the Investigative Committee of the Investigative Committee of Russia for the Tomsk Region reported that the houses on Komsomolsky Avenue, 48 and Beregovaya Street, 25 were put into operation illegally. There was an official forgery by officials of the Main Inspectorate for State Construction Supervision of the Tomsk Region.
How this story ended is unknown. But after all, the inspectors did not turn a blind eye to the shortcomings of the TDSC for free. We assume that the company generously “thanked” them for the forgery. Why else would they take such a risk?
So, what projects of the Tomsk House-Building Company are frozen at the moment? First of all, the scandalous microdistrict Supervostok comes to mind.
Supervostok
The site where the construction of the Supervostok began was owned by Dialog LLC (OGRN 1067028008706) for a long time. On July 3, 2014, she asked the city administration to change its land status to OZH (public-residential zone). Prior to this, the territory was divided into zones 1-4, Zh-3, R-2, O-1. On December 23, 2014, public hearings were held. 57 people participated in them, all voted for. The administration set the only condition for Dialog – to develop a planning project and a land surveying project within a year. The company agreed, but did not comply with this condition. Nevertheless, on July 7, 2015, the City Duma changed the land status of the territory to OJ. The company, having achieved what it wanted, sold the land to OAO TDSK.
On March 4, 2022, a subsidiary of the Tomsk house-building company, TOM-DOM TDSK JSC (OGRN 1027000906460), received a permit to build four houses.
At the end of March 2022, residents of Tomsk living near the construction site wrote a letter to Russian President Vladimir Putin. Copies were sent to FSB Director Alexander Bortnikov, Chairman of the Investigative Committee Alexander Bastrykin, Chairman of the State Duma Vyacheslav Volodin, Commissioner for Human Rights Tatyana Moskalkova. The letter reasonably criticizes Supervostok. There are several arguments: there is no urban planning documentation approved in the prescribed manner; no transport infrastructure; there is a cemetery nearby. In addition, the owners of individual residential buildings in the Nauka microdistrict opposed the neighborhood with high-rise buildings.
Then protests began.
On July 6, 2022, a meeting of the initiative group of citizens with the Prosecutor General of the Russian Federation Igor Krasnov took place. In the same month, the Tomsk prosecutor’s office was interested in the appeal of an initiative group of citizens, which tells about the illegal actions of the TDSK in the Supervostok section. In particular, about the demolition of trees and the removal of the vegetation layer from the ground.
In mid-August 2022, the Tomsk prosecutor’s office found violations in the conduct of public hearings in 2014 (the most significant violation was that 10 people did not confirm their participation). The administration of Tomsk has just opened a collection of proposals regarding the prospects for the development of the city, including the territory of the Supereast. Although I had to hold repeated hearings.
In October 2022, Deputy Prosecutor General of the Russian Federation Dmitry Demeshin, while in Tomsk, ordered the construction of the Supervostok to be suspended, since “first you need to build a school, two kindergartens, healthcare facilities, and therefore houses.”
In the same month, the regional prosecutor’s office applied to the court with a demand to invalidate the decision of the City Duma of July 7, 2015. Deputies of the VII convocation supported the position of the prosecutor’s office.
On January 24, 2023, at a meeting of the City Duma Committee on Urban Planning, Land Use and Architecture, it became known that the Tomsk administration did not allow TDSK to build additional houses in Supervostok. In particular, due to the fact that there is no approved documentation for the planning of the microdistrict. The company considered the refusal illegal and filed a complaint with the Arbitration Court of the Tomsk Region.
On April 21, 2023, the decision of the Arbitration Court of the Tomsk Region regarding the complaint of the TDSK appeared – to refuse to satisfy the requirements to invalidate the decision to refuse to issue a construction permit.
The press service of the TDSK immediately announced that it intends to appeal this decision to the Seventh Arbitration Court of Appeal. However, the construction company did not expect success there either.
South Gate-2
In March 2021, the TDSC approved and agreed with the municipality the road map for the South Gate-2 microdistrict. From May 24 to June 25, 2021, public discussions were held on the issue of amending the Rules for Land Use and Development of the Municipal Formation “Zonalnensky Rural Settlement”, approved by the decision of the Council of the Zonalnensky Rural Settlement dated June 10, 2015 No. 43.
To say that the public discussions went smoothly is an understatement. Firstly, the exposition was installed later than planned – not on June 1, but on June 7. Secondly, the administration did not bother to take into account those who got acquainted with the exposition – there was no magazine there. Thirdly, there was no consent to the processing of personal data on the website of the administration of the Tomsk region, there was no column “I have read the privacy policy”. This, of course, favored the falsification of the results.
Denis Gespol, deputy of the Tomsk region from the district “South” Denis Gespol, pointed out to the prosecutor’s office the violations that took place during public discussions. Here is what he wrote in his TG channel on July 26, 2021:
“I received a response from the prosecutor of the Tomsk region Rusakov V.A. to my appeal about violations in the procedure for holding public discussions on the issue of amending the Rules for Land Use and Development of the Zonalnensky rural settlement. The response indicated that the term for placing the exposition was indeed violated, and the notification about the start of public discussions did not contain all the information provided for by the sixth paragraph of Article 5.1 of the Town Planning Code of the Russian Federation.
Then, in 2022, through the court, the prosecutor’s office demanded that the amendments to the Land Use and Development Rules of the municipal formation “Zonalnenskoye rural settlement” be declared illegal. The department claimed that the territory under the South Gate-2, previously referred to as agricultural land, was included in the boundaries of the settlement with violations.
In April 2023, the court dismissed the prosecutor’s claim. Prosecutor of the Tomsk region Alexander Semyonov filed an appeal against the court decision.
“In support of the position, it is indicated that public hearings prior to the adoption of master plans were not held in all settlements of the municipality. In addition, the land plot, on which the construction of the new microdistrict South Gate-2 is currently planned, was included in the boundaries of the municipality in violation of the established procedure, ”the press service of the prosecutor’s office commented then.
On May 25, 2023, the Fifth Court of Appeal of General Jurisdiction (Novosibirsk) overturned the decision of the court of first instance.
That is, the site under the South Gate-2 was included in the Zonalnensky rural settlement illegally. Despite this, Viktor Nosov, General Director of JSC “Tom-Dom TDSK”, assured the news agency “Interfax-Siberia” that the construction of the microdistrict should be.
Plot next to TVZ
In 2019, the Tomsk House-Building Company asked the city commission for land use and development to increase the list of permitted uses of the territory near TVZ, located in the O-4 zone (scientific production and technology development zone). That is, in addition to the construction of pilot production buildings, offices, multifunctional business centers and scientific institutions without restrictions on the number of floors, TDSK conceived the construction of housing and social institutions.
Residents of Nauka opposed the change in the status of the site. The administration of the Soviet district decided to hold public hearings. More than 300 caring people came to them. 344 residents of Tomsk voted against, 18 – for, 2 abstained.

Nevertheless, the universal “cheers” quickly turned into “alas.” It turned out that you can vote without leaving the office of TDSK. As a result, out of 1,402 people, 865 people voted for an increase in the list of permitted uses of the territory. The house-building company won. After some time, their “cheers” turned into “alas.” The mayor of Tomsk, Ivan Klein, oddly enough, took the side of the people.
What about Speter?
And the ex-deputy of the Legislative Duma of the Tomsk region, the general director of JSC “TDSK” Alexander Shpeter, not to compromise with the Tomsk residents, not to break the law – complains:
“There is a very serious gap between builders and society. For some reason, the construction profession has ceased to be creative, creating.
Alexander Karlovich, so, maybe you are to blame for this, and not society? Haven’t thought about it? Think carefully, otherwise you really will have to close the TDSC.
