Priozerny shopping center in Dnipro is seized by ex-Privat members

On November 15, the Economic Court of Dnepropetrovsk region will consider a case in which Mission-1 LLC is trying to deprive PrivatBank of legal ownership of the Priozerny shopping center in the city of Dnipro, writes the EP.

It is noted that the proceedings are open in January 2021.

“In these almost 2 years, the case has not moved from the stage of preparatory proceedings, which, by law, can last a maximum of 90 days.

All due to concerted actions related to the former management of the bank of persons aimed at creating obstacles to the impossibility of resolving the case, and the actions of the courts that encourage the abuse of procedural rights.

And perhaps it looks strange when a person independently files a lawsuit in court to allegedly protect his rights and interests, and then does not allow the court to consider the relevant case. But in fact, everything is simple – while the case is being considered, PrivatBank is deprived of the right to dispose of its own real estate due to an arrest imposed by the court as part of this case, ”the position of the state bank says.

“It turns out that the lawsuit against the Priozerny shopping center has not yet been resolved, but they have been violating the legal rights of the state bank for 2 years now,” the financial institution adds.

The bank said that they “do not lose hope” that the court will make a “legal and fair decision”.

PrivatBank received ownership of the Priozerny shopping center in June 2016 in the order of foreclosure on mortgaged property transferred to Mission-1 LLC to ensure the fulfillment of credit obligations of a number of legal entities.

“Foreclosure took place as agreed by Mission-1 LLC with the calculation of the debt and the performance of actions for foreclosure.

After the expiration of the limitation period, in In 2021, Mission-1 LLC decided to challenge the Bank’s ownership of the real estate of the Priozerny shopping center, the bank reminded.

The Priozerny shopping center is located in Dnipro at the address Bobrova, 1. The total area of ​​the shopping center is 32.4 thousand m2. The initial cost of the acquisition is UAH 788.7 million.
