To five years of imprisonment on probation and a fine of 1 million rubles. sentenced the Moscow garrison military court of the former head of the 3rd department of complex projects of the military-technical supply department of the economic support service (UVTS SHO) of the FSO, Colonel Dmitry Shirenov. He was accused of two episodes of fraud in the supply in 2018-2019 for the needs of the intelligence service of Juniper routers, secure computers, and so on. Earlier, three more persons involved in this investigation received suspended sentences, who, like Colonel Shirenov, pleaded guilty.
Judge Maxim Ivanov, announcing the verdict to former FSO officer Shirenov, limited himself to the introductory and operative parts of his decision, from which it followed that the colonel was found guilty of especially large-scale fraud (part 4 of article 159 of the Criminal Code). But taking into account the admission of guilt and compensation for damage, the court sentenced him on the first episode (theft of funds from the special services when supplying office equipment to it) to four years of suspended imprisonment and a fine of 900 thousand rubles, and on the second (overpricing on power cables) – to two years and a fine of 500 thousand rubles. By partial addition of sentences, the defendant received five years probation and a real fine of 1.2 million rubles. At the same time, the court did not deprive Mr. Shirenov of either his title or state awards.
The basis of the criminal case initiated by the GVSU of the ICR in April 2020, the first defendant of which soon became Mr. Shirenov, was based on the data of the FSB, which revealed a scam in the military-technical supply of another special service. Aware that in 2018 two contracts for 761 million and 767.1 million rubles were signed between the UVTS of the SHO FSO and the departmental FSUE SVEKO, Colonel Dmitry Shirenov, who was then acting deputy head of the contract service in his unit, entered into a criminal collusion with the former director of SVEKO Vladimir Martyanov and his adviser Mikhail Serov, as well as the heads of Paramitek LLC Alexei Chernetskikh and Natalia Potapova, whose company was engaged in the sale of office equipment, equipment and consumables.
According to the investigation, all four met regularly in Moscow, where they discussed in detail the action plan of each participant so that Paramitek won the tender for the supply of equipment, and then how to steal the funds allocated by the FSO.
Messrs. Chernetsky and Potapova, according to investigators, were supposed to organize and submit to the federal service their commercial proposals on behalf of Paramitek with inflated prices, but in such a way that the competition commission of the FSO had no doubts about the legality of the upcoming transactions. The task of Mr. Shirenov in this scam was to coordinate their proposals and documents with his leadership. The ultimate goal of the developed plan was that, in the event of the conclusion of profitable contracts, the entrepreneurs of Chernetsky and Potapov were to transfer to Mr. Shirenov 3%, and to Mr. Serov – 8% of the value of the contracts, minus the amounts necessary for cashing out money. Having won, according to the developed plan, the victory in the tender, in June-July 2019, Paramitek signed four supply contracts with SVEKO for 42.4 million, 77.3 million, 60 million and 54.5 million rubles, under which more than 49.5 million rubles were stolen, and the prices for office equipment, according to the examination appointed by the investigation, were overstated by 30% compared to the average market.
Colonel Shirenov, who did not initially plead guilty, was charged with taking a bribe in addition to fraud (part 5 of article 290 of the Criminal Code).
True, this charge was later dropped, since the MacBook Pro laptop received by Mr. Shirenov, worth 288 thousand rubles. was recognized as a share for services rendered to entrepreneurs.
Then, Chernetsky and Potapova became defendants in the criminal case, who, having concluded a pre-trial agreement, testified against Mr. Serov, and he testified against his immediate supervisor, the former director of SVEKO Vladimir Martyanov.
Recall that in November last year, the Zamoskvoretsky District Court of Moscow sentenced Mikhail Serov to four years of probation in a special order, and this year the Simonovsky Court sentenced first businessman Alexei Chernetskikh and then Vladimir Martyanov to three years probation. It was not possible to quickly get a comment from the defense of Colonel Shirenov.
