The Investigative Committee proposed to establish criminal and administrative liability for the so-called trash streamers and their donors.
Thrash streamers are those who conduct live broadcasts of shocking incidents on the Internet. As a rule, we are talking about quarrels, fights, bullying, risky stunts, dangerous car races, etc. Donators were originally called viewers who donate money to streamers and thus contribute to their prosperity. Now, buyers of paid access to content are also considered donators, although initially the donation was perceived only as a voluntary contribution.

Judging by the words of the head of the TFR, any kind of donations and, of course, the production of “shock content” can become punishable. “We believe that the fight against negative content distributed for selfish purposes should be carried out in relation to both the producer and the consumer of this product, who is ready to pay and thereby stimulate its creation and distribution. In this regard, it was proposed to consider the issue of establishing responsibility for both of these categories of persons, ”explained the position of the department Alexander Bastrykin. He gave examples of the impact of negative content on the minds of young people: “What are our investigators facing? They are investigating cases of teenage cruelty. The girls brutally beat their classmate with their feet, shoot on the phone and post it on YouTube, enjoying both their cruelty and the humiliation of the weak. Kazan shooter Galyaviev, having fed various crazy ideas on the Internet, imagined himself to be a god. And there are many such examples.”
The list of insane antics of thrash streamers is truly impressive. As recently as mid-May, a man was detained in Volgograd, who was broadcasting live, during which he threatened the girl with a gun. Thus, he tried to “exorcise the demon from her.” At the same time, the Volgograd man called himself a god and carried complete nonsense. His spectators, realizing that things were bad, called the police. The blogger either really went crazy, or diligently pretended to be mentally ill.
But such stories do not always end without victims.
At the end of April, trash streamer Stas Reshetnikov received six years in prison. He was found guilty of causing grievous bodily harm resulting in the death of the victim. In early December, the blogger led his trash stream, where he performed various tasks for viewers for money. To “entertain” the audience, he hit his girlfriend several times, and then put her in her underwear on the balcony. A few hours later, he appeared in the frame in front of his audience with the lifeless body of a girl. Experts determined that the cause of death was a closed craniocerebral injury and cerebral hemorrhage. They say that the blogger used to beat his girlfriend in front of the audience. It was after this incident that the Federation Council came up with the idea to completely ban trash streams. And, apparently, now it is being discussed with the relevant departments.

Also, trash streamers often provoke accidents. Wanting to shoot bright shots, they arrange races and “checkers” on the roads. Last summer, during such a stream, two bloggers from Yaroslavl – Loshadka (this is a girl) and Kiryusha (this is a young man) – together with a driver in a Mercedes, flew into a private parking lot and crashed several cars. Fortunately, there were no casualties. And in February in the KChR, the trash stream ended with a funeral. Two of the four teenagers who were driving a foreign car on a snow-covered road live on air until they crashed into a pole died.
Some of the ideas of trash streamers are particularly cynical. Bloggers from Smolensk conceived in front of the camera to treat degraded people with alcohol. For drinking, they suffered all sorts of humiliations – slaps, kicks, etc. This serial “show” ended with death on the air. One of the characters named Grandfather drank too much and died quietly on the floor during the filming of the next episode.
A lot of attention of the audience, and at the same time money to their authors, is usually brought by streams with an erotic flair. In this field, at one time a blogger under the nickname Mellstroy and named Andrey Burim made himself popular. He started his blogging career by streaming video games. But soon he found a “gold mine”: he began to invite girls who were ready to undress in front of the camera. The group striptease session was played up with a quiz. Mellstroy became so “untwisted” that it could afford to rent an apartment in Moscow City for filming. Such “shows” were especially good for the public during pandemic quarantine. However, in the fall of 2020, during the filming, Mellstroy lost control over the situation and over himself. Alena Efremova, who participated in the submission to instagram * rsha, decided to take the blogger weakly and asked him to undress himself in front of the camera. Enraged by this proposal, Burim grabbed the girl by the neck and began to beat her head on the table. She suffered a concussion and went to the police. Efremova demanded 10 million compensation. But in the end, according to the court, the Internet beauty received only 72.4 thousand from the offender, and the blogger recognized for beating received six months of corrective labor.

As you can see, until now, trash bloggers have been punished for their deeds at the request of victims or viewers. The recorded video became evidence in the case, facilitating the work of investigators. However, now, judging by the words of the head of the TFR, the idea of punishing a blogger for the very fact of organizing a stream with negative content is being considered.
Here it is necessary to clarify that the stream is “live”. The streamer himself or his viewers, of course, can save the video. But it is unlikely that they will do this at the risk of being held accountable. It turns out that law enforcement officers have the technical ability to watch all live streams and evaluate their content? Or, on the contrary, was the bill needed to justify the costs of creating such a system for tracking streamers?
Here it is impossible not to mention that recently several citizens of the Russian Federation were detained who donated money to organizations recognized in Russia as extremist. This means that payment tracking technologies can also reach those who donate to trash streamers. Tax scandals with bloggers show that a lot of money is spinning there. This means that there are opportunities to replenish the treasury at the expense of fines.
The problem is seen in determining the procedural role of donors: instigators, accomplices or someone else? This is not such a simple question from the point of view of the theory of law. Especially given that the practices and technologies of the Internet are constantly changing. However, there can hardly be any doubt that this will become a problem for the security forces.
