As it became known to Kommersant, the Main Investigation Department of the Investigative Committee of Russia (TFR) for Moscow opened a fourth criminal case against businesswoman Tatyana Alyabyeva, already convicted of abuse of power in the implementation of the state defense order (part 2 of article 201.1 of the Criminal Code of the Russian Federation). According to the investigation, already partially confirmed by the Moscow City Court, the owner of SD Atrium LLC Alyabyeva received large subcontracts for the construction of civilian facilities of the Ministry of Defense, and the funds received for the construction of schools, apartment buildings and barracks in military camps were withdrawn through shell companies controlled by her. Even the Main Intelligence Directorate (GRU) was among the victims.
Employees of the TFR department for the South-Western Administrative District of Moscow uncovered a scheme for the alleged abuse of 45-year-old Tatyana Alyabyeva. From the plot of the criminal case initiated on this occasion, it follows that in the summer of 2019 the owner and general director of SD Atrium Alyabyeva, her deputy Pyotr Dorofeev and unidentified persons affiliated with the Ministry of Defense FSUE Main Military Construction Directorate for Special Facilities decided to abuse their powers. To do this, according to the investigation, they “entered into a criminal conspiracy and assigned roles.”
As part of the agreements reached, the unknown leaders of the Federal State Unitary Enterprise then subcontracted to SD Atrium a large order they received from the Ministry of Defense for the reconstruction of the barracks and housing stock of the military unit of the GRU Senezh special forces in Solnechnogorsk near Moscow.
In accordance with the terms of the state contract, LLC was transferred in advance 80% of the cost of work and materials – 295 million 95 thousand rubles. However, by the deadline set by the agreement, February 1, 2020, new barracks did not appear in the unit.
Then Tatyana Alyabyeva and her curators from the Federal State Unitary Enterprise explained the delay by force majeure, and only three years later the investigation found that the problem was actually in a rather strange distribution of construction contracts. According to the Investigative Committee of the ICR, having received the order, Tatyana Alyabyeva and her deputy “ceded” their rights to perform work to a dozen other LLCs. Among them were, for example, the Mechanization Department, K-Trade, the engineering and technology company Ecotor, the trading house Elektrotekhmontazh and Quick Sales.
According to the investigation, all these firms “had signs of fictitiousness” and could not fulfill their obligations under contracts, but were affiliated with the accused or controlled by them. Tatyana Alyabyeva and Pyotr Dorofeev, according to the investigation, “knew” about this and “deliberately went to harm the legitimate interests of the Ministry of Defense” for personal gain.
According to the Investigative Committee of the TFR, the merchants transferred at least 29 million 900 thousand rubles to shell companies, which were then spent on some “not related to the state contract” purposes.
It is worth noting that the investigation has been dealing with the activities of Tatyana Alyabyeva for several years. She was first prosecuted back in 2020 after studying the details of another major state defense order – to carry out work in the part of the strategic missile forces in the Irkutsk region. As part of the contract in Irkutsk-45, it was planned to build a whole complex of school buildings – two blocks for junior and senior classes, a library, a sports and recreation complex, a canteen, etc., the cost of the work amounted to 928 million 735 thousand rubles.
This order, as it was established by the investigation, was assigned to Tatyana Alyabyeva by another general contractor affiliated with the Ministry of Defense – JSC “Main Department for the Arrangement of Troops”. Having received the right to build, SD Atrium, according to the already known scheme, distributed the work among three dozen shell companies and transferred large advances to their accounts located in the same number of banks.
By May 1, 2020, when the school was supposed to be commissioned, it turned out that the facility was 3.5% ready.
In the Cheryomushkinsky District Court of Moscow, which examined the criminal case on the construction in Irkutsk-45 on the merits, the defendant tried to explain that the deadlines for the production of work were disrupted by the unexpected flooding of the pit with water and the need to change most of the design decisions in connection with this. However, the court did not accept the businesswoman’s arguments, found her guilty of abuse of power in the implementation of the state defense order and sentenced her to four years in prison with a suspended sentence. In addition, Tatyana Alyabyeva was fined 750 thousand rubles.

She pleaded not guilty and filed an appeal with the Moscow City Court against the excessive severity of the sentence. In turn, the Moscow Prosecutor’s Office was also dissatisfied with the decision of the district court, which considered it too soft. As a result, on February 24 last year, the city court, having accepted the arguments of supervision, changed the suspended sentence for the convict to a real one. The military builder was taken into custody in the meeting room and sent to a pre-trial detention center.
Interestingly, having found herself in a new status for her, Tatyana Alyabyeva changed her attitude towards the investigation.
According to the Investigative Committee of the ICR, she pleaded guilty, repented, and even entered into a pre-trial cooperation agreement with the Moscow Prosecutor’s Office, under which she told the investigation about other episodes of abuse and the role of her likely accomplices in these crimes. Thanks to her testimony, during the past winter, the investigation identified and charged at least four more alleged participants in the abuses committed during the construction of an apartment building for military personnel in Irkutsk and the “barracks and housing stock” of a military camp in Ulyanovsk. The investigation believes that of the funds allocated for the construction of these two facilities, at least 100 million rubles. were transferred to the accounts of one-day firms and disappeared.
The latest criminal case on the construction of a barracks for special forces from Solnechnogorsk was also initiated thanks to the repentance and cooperation with the investigation of the main accused.
