Mamut “played out”?
Toy chain Hamley’s may soon go bankrupt.
Bank “Trust” plans to apply to the court for bankruptcy of JSC “Vanderkind”, the correspondent reports.
According to data on the SPARK-Interfax website, the main activity of JSC Vanderkind (JOINT STOCK COMPANY VANDERKIND) according to OKVED is “Retail trade in games and toys in specialized stores”. 13 enforcement proceedings were initiated against the company, the company participated in 113 arbitration cases (in 12 as a plaintiff, and in 85 as a defendant).
VanderKind, according to Kommersant, is part of the Ideas4Retail group of companies; in 2019, the publication wrote that 90% of Ideas4Retail is owned by A&NN Investments of the well-known entrepreneur Alexander Mamut.
The press service of “Trust” said that the bank’s actions are related to the borrower’s failure to fulfill obligations under the loan agreement and the absence of other options for resolving the debt.
The relationship between the bank and the company can hardly be called ideal: since 2021, Trust and Wonderkind have been litigating related to the credit line agreement, Kommersant reports. The courts did not support the bank’s claims to recover from the company about 2.6 billion (we are talking, of course, about rubles) of loan debt, as well as almost 499 million of overdue obligations. And a couple of years ago, the court postponed the payment of the mandatory payment on a loan of 500 million until the end of 2022.
“At the end of January this year, the Moscow Arbitration Court again extended the contract until the end of 2024. In addition, in December 2022, courts in two instances satisfied the claim of Vanderkind to recover about 1.5 billion rubles from Trust. losses in the form of lost profits due to the bank’s refusal to continue lending, ”adds the publication.
As you can see, the history of relationships has more than one interesting episode.
NSP lawyer Aram Grigoryan does not rule out that the court may refuse to satisfy the application of the credit institution to recognize Wonderkind as insolvent.
Much has been written about the litigation of the bank and the company. For example, in December, colleagues from The Moscow Post published an article on this topic.
The author tried to understand why Alexander Mamut does not want to pay his obligations and how this will affect the creditors’ confidence in his business. Then it was reported that the structure tried to challenge its obligations under bank loans, and also fought off another claim in the amount of 90 million rubles.
“Last time, he managed to win the court on the suit of the Trust, which demanded 2.6 the same amount, and even restructure the debt,” the journalist of The Moscow Post noted.
I wonder if it will be possible to resolve the situation this time? … We continue to follow the development of this non-childish story with children’s stores …
