Bucha and Irpin once again clashed over the question of who should provide water to the inhabitants of Bucha and Vorzel. In Bucha, they say that the company itself operates in the company “Buchaservis” and it is exclusively a service provider. The KP has all the necessary permits, and therefore the right to issue invoices for payments, the authorities say. The Irpen society has a different opinion – residents are urged to continue paying under existing agreements in the Irpenvodokanal utility company. The situation can be solved by creating a joint ownership company. But as the communities contemplate whether to smoke the peace pipe, only the residents continue to suffer.

As the situation was clarified by the KV in KP Irpenvodokanal, the official transfer of water supply and sanitation facilities from the Irpen Vodokanal to Buchansky was never carried out.
“We get a lot of calls about this, consumers come and personally complain about the situation. We explain as follows: we work on the basis of permits and no changes to disconnect water supply facilities from the enterprise or relevant permits have been adopted. There are no decisions regarding the transfer of these water supply and sanitation facilities, which are located in Bucha and Irpen. There are no agreements that could regulate this issue of transfer from one enterprise to another“, – say in the KP.
It is also added that the contractual relationship with consumers is valid and there were no grounds for breaking it.
“Therefore, we inform our consumers and encourage them to continue paying for the services received. KP “Irpenvodokanal” has been providing services to residents of Bucha and Vorzel for many years. Everything is on the balance of our CP, as it is written in the relevant permits. The Buchansk city council decided that Buchaservice would be the service provider, provided legal support for these actions, but no acts were signed on the transfer of facilities from Irpenvodokanal to Buchaservice. Therefore, we also have no grounds for removing the relevant property from the balance sheet.a,” added the Irpenvodokanal KP.

In turn, the secretary of the Buchansk City Council, Taras Shapravsky, told CV that, in accordance with the decision of the Buchansk City Council, the provision of water supply and sanitation services was still determined by the KP “Budservis”. Accordingly, the enterprise has a license for the right to carry out economic activities, a special permit for the use of subsoil and water use – that is, the entire package of documents necessary for the provision of relevant services.
Moreover, all facilities are owned by the community and under the economic jurisdiction of the KP – these are artesian wells, clean water reservoirs, etc., as well as contracts for electricity supply with DTEK.
“There is no object in the ownership or use of Irpenvodokanal in Bucha, and in fact it does not provide services, and has no right to do so. Therefore, any attempts by Irpenvodokanal to issue invoices will simply look like fraud. Since the company does not incur expenses, but tries to illegally issue payments and collect funds from citizens. From the point of view of legislation, the balance sheet is only a form of accounting. In order to put something on the balance sheet, you need to have a real right. A real right is either the right of ownership or, accordingly, use on the basis of a contract. Today KP “Irpenvodokanal” cannot show a single contract that would testify that these wells or facilities were in its use, and only the Buchansk community, as the owner, could transfer them to use. Because it is the critical infrastructure of society.
In fact, Irpenvodokanal arbitrarily and without the consent of the owner, without any reason, put these objects on its balance sheet. The right of ownership is registered in the register of real rights in the Buchanskaya community, and economic management, as a real right, is registered in Buchaservis, which, on the basis of this, put all objects on the balance sheet“, Shapravsky said.
And he added that during the period of hostilities, occupation, and indeed from February 24, Irpenvodokanal stopped servicing networks on the territory of their community.
“Apart from Internet publications that they are service providers, no action is taken. This can be confirmed by each head of condominiums and residents. If there is a rupture in some water supply, Buchaservice comes out and eliminates it, the sewerage system is clogged, the Buchaservice emergency service leaves. All sewage pumping stations and wells are healed with generators that are on the balance sheet of Buchaservice, which ensures their uninterrupted operation in blackout conditions. Taxes from the activities of the enterprise are paid to the budget of the company. We are not rich enough to subsidize neighboring communities. Jobs are also created within the community, so there is also economic patriotism in this process‘ he says.
According to him, the issue of centralized drainage is currently at the stage of settlement. After all, Bucha, Irpen and Vorzel do not have their own treatment facilities. Sewage flows are pumped to the network of PJSC “Kyivvodokanal” – to the Bortnytska aeration station.
“We have developed and sent for signing a trilateral agreement between KP Buchaservis, KP Irpinvodokanal and Kyivvodokanal regarding the acceptance of our effluents and the settlement of this issue as well. The contract is under consideration – we hope to receive a positive response“, he remarked.

An interesting fact is that on January 27, the chairman of the Irpin city community Alexander Markushin officially informed consumers of water supply and sanitation services of KP “Irpenvodokanal” from the city of Bucha and the village of Vorzel that a joint discussion was held by the city chairmen of Irpen and Bucha. And that, as a result of them, a decision was made to create in 2023 an enterprise jointly owned by the Irpin and Buchansk City Councils. He supported this message on Facebook with official documents.
“At the next session, we are planning to make an appropriate decision (it is known that the session should be held on February 9 – from TC). Until the creation of a new joint ownership enterprise, the sole provider of all water supply and sanitation services in the city of Bucha and the urban-type settlement of Vorzel remains KP Irpenvodokanal. The contracts concluded by you with KP “Irpenvodokanal” are valid, respectively, the provision of services and payment according to them is carried out in the future. We also emphasize that all networks, water supply and drainage facilities are today on the balance sheet of KP “Irpenvodokanal”“, – said the mayor of Irpin.
And he added that KP “Irpenvodokanal” also operates on the basis of permits for water use, groundwater intake from wells, and discharge of wastewater is carried out in the network of JSC “Kyivvodokanal” also on the basis of a concluded agreement for the reception of wastewater through the sewer networks of cities.
“The creation of a new enterprise will be reported on official sources and in the media. At the same time, consumer services in the Irpen and Gostomel communities will continue to be carried out exclusively by KP Irpenvodokanal, a joint venture with the Buchan community will serve consumers in Bucha and Vorzel‘, says Markushin.

To do this, KP “Buchaservice” must conclude a tripartite agreement with KP “Irpenvodokanal” and KP “Kyivvodokanal”. As of today, no such agreement has been concluded and it will not be concluded until the process of creating a joint venture is completed. KP “Buchaservis” has no other option than through Irpen for the transportation of wastewater. Any attempt to transport effluents without a tripartite agreement will be illegal and this transport will be stopped immediately. Thus, the actions of the management of the KP “Buchaservis” expose the residents of Bucha and Vorzel to environmental disaster. As of today, there is no need to “run ahead of the train” under the name of “joint utility”, as this running will have more negative than positive consequences.“, he notes.
In turn, CP “Buchaservice” also confirmed this information, but noting that these processes are only at the initial stages and drew attention to the fact that nevertheless the only service provider in the territory of the Bucha service is only CP “Buchaservice”.
“Understanding the position of Irpen and their desire to have a joint venture with Bucha, we really met their request and are ready to form a common group for negotiations. We would like to inform you that real negotiations have not started yet, and the process of possible formation of a joint venture may take more than one month. All this time it is necessary to maintain networks and provide services to subscribers. KP “Buchaservis” already provides water supply and sanitation services. Our utility company has been operating for almost a year, reconciling meters and making charges for January 2023”, — note in CP.
Bucha and Irpen: contractual relations and tariffs

As Taras Shapravsky, secretary of the Buchansk city council, explained to KV, each contract for the provision of services is typical and its validity period is one year. Therefore, each citizen can refuse this service by notifying Irpenvodokanal in writing.
“The legal department of “Buchaservice” has developed the corresponding templates of appeals and many of the residents have already sent the corresponding messages to “Irpenvodokonal”. In addition, according to the law, an agreement on the provision of water supply and sanitation services is a public offer agreement. If the contract was published on an official resource, in this case on the website of the City Council, and within 30 days there were no comments or refusals to it, then payment of the first accrued payment for services will mean agreement on the conclusion of contractual relations with KP “Buchaservis”‘ says the secretary.
According to him, “Buchaservice”, as a service provider, is currently sealing the meters and in early February will insert the appropriate payment for the population. And, if the consumer did not have time to seal the meters for any reason, according to the law, the norms of water consumption per person, approved in accordance with the decision of the executive committee of the Buchanskaya TG, are applied.
As for tariffs, Buchaservice did not raise them for residents.

So, if we take the total amount for centralized water supply and drainage, then it comes out at the level of 30 hryvnias with kopecks, while in Irpenevodokanal it is 32 hryvnias with kopecks. And for the period of martial law, we do not revise or raise tariffs, because we understand the situation in the state. This is done in order not to create tariff pressure on individual households.“, – added the secretary of the community.

Recall, as KV previously reported, that another scandal between neighbors Irpin and Bucha erupted at the beginning of last year, before the war. Bucha and Vorzel decided to separate from the Irpensky water utility, creating their own water supply network. Then such intentions were condemned in Irpin: saying that this is necessary not for residents, but for Bucha developers to simplify the procedure for obtaining permits, while the locals will drown in the slop without the Irpin sewer.
In turn, the State Water Resources Agency asked to cancel the license issued by the Buchaservice enterprise for the well, which was already used by Irpenvodokanal.
Already in July 2022, Irpenvodokanal was suspected by the authorities of Bucha in an attempt to seize a utility company located on the territory of the city of Bucha and the village of Vorzel. The head of the KP said that residents served in Irpenevodokanal were forced during the war to renegotiate contracts with the KP Buchaservis, without having the appropriate documents and permits for this. Therefore, KP “Irpenvodokanal” appealed to the Buchansk City Council, to KP “Buchaservice” with a request to stop the raider seizure of water supply and sewerage facilities in the city of Bucha and the village of Vorzel. They also asked residents not to allow themselves to be misled and not to conclude contracts with Buchaservice.
The authorities of the Buchanskaya community were not slow to respond to the reproaches regarding the raider seizure of the Irpenvodokanal utility company and the luring of consumers to the Buchaservice utility company. The city council then assured that the information appeals of Irpenvodokanal were nothing more than manipulation and an obstacle to the activities of the local utility company.
In addition, they noted that the provider of services for centralized water supply and centralized sewerage in the settlements of the Buchansk city territorial community was authorized by the KP “Buchaservice” SMP, which has all the relevant solutions. And that the authorities of Bucha informed them about the termination since March last year of the provision of services for centralized water supply and centralized drainage in the city of Bucha and the village of Vorzel.
