Despite the objections of the prosecutor’s office, the court decided to release the former general director of Voentelecom JSC Alexander Davydov on parole from places of deprivation of liberty. Four years and two months in prison for embezzlement of about 1.4 billion rubles. The convict in a special order received budgetary funds for the implementation of contracts concluded with the Ministry of Defense in October last year, and already in December filed a petition for parole. By that time, Alexander Davydov had spent exactly half of the sentence in custody, and the court considered that he had proved his correction.
Having filed a petition for parole shortly after the verdict was passed, the former general director of Voentelekom, Alexander Davydov, was waiting for his fate in SIZO-4 Medved, located next to the Babushkinsky District Court of the capital. When considering his case, it turned out that the only obstacle to release could be the position of the prosecutor’s office. The objections of the representative of the supervisory authority were related to the fact that Alexander Davydov did not compensate for the damage caused to the state. True, a fine of 800 thousand rubles imposed in addition to the term by the Meshchansky District Court. the convict has already repaid. Apparently, this circumstance, as well as the position of the SIZO administration, which supported the convict’s request for parole, played a role.
After analyzing the submitted materials, Judge Natalya Kurysheva concluded that the convicted Davydov “took measures” to compensate for the damage caused to the state, but could not do this “due to objective reasons.”
It should be noted that the Meshchansky District Court, declared by the Ministry of Defense during the consideration of the criminal case, transferred the claim to the ex-head of Voentelecom to civil proceedings. Also, by a court decision, the numerous property of the ex-general director remains under arrest at the moment: apartments, houses, land plots, cars and several expensive watches.
As a result, the Babushkinsky District Court came to the conclusion that the former head of Voentelekom had proved his correction and could be released from further punishment. However, the prosecutor’s office challenged the decision of the court of first instance by filing an appeal. At a meeting in the Moscow City Court, scheduled for March 14, the supervisory authority intends to seek further execution by Alexander Davydov of his sentence.
As Kommersant has already said, Mr. Davydov received his term for fraud on an especially large scale (part 4 of article 159 of the Criminal Code of the Russian Federation). He came under criminal prosecution in December 2017 after the detention and arrest of his adviser Dmitry Semiletov and first deputy Oleg Savitsky, as well as the general director of RSI LLC Tatyana Ilyina. All of them were charged by the TFR with complicity in the theft of about 1.4 billion rubles. during the implementation of contracts concluded with the Ministry of Defense.
As the investigation and the court established, in 2013-2015, the members of the criminal group organized the supply of cheap Chinese analogues with re-labeled instead of Russian routers to the customer.
In addition, the leaders of Voentelecom were also charged with fraudulent activities in the implementation of field supervision of satellite communications. For the implementation of this state contract, 249.5 million rubles were allocated from the budget, of which 191.4 million were stolen. True, Voentelecom returned this money to the treasury voluntarily.
In the summer of 2018, all the defendants pleaded guilty, entered into pre-trial cooperation agreements and were released. At the same time, they all testified against other participants in the fraud, thanks to which charges were brought against the former head of the 1st department of the main communications department of the Ministry of Defense, Major General Alexander Ogloblin, who acted as a representative of the state customer when signing contracts with Voentelecom, the head of the department for orders for improvement command and control system of the military department, Colonel Pavel Kutakhov and Deputy Chief of the General Staff of the RF Armed Forces, Colonel-General Khalil Arslanov. The latter is considered by the investigation to be the organizer of the fraud, during which the cost of the equipment ordered from Voentelecom was inflated by 25-50%. According to the investigation, the members of the criminal group divided the money received among themselves.
All the civilians involved in the machinations, as well as General Ogloblin, have already been convicted in a special order. Moreover, two of them have already been released on parole. The trial of the rest of the military is now underway in the 235th garrison military court in Moscow. The parties listen to the prosecution’s evidence.
