Divorce in a noble family
Property of a bankrupt major Bashkir businessman Marcel Yusupov are sold at auction, and the results of the latter are actively disputed in the courts. The former head of the republic, Murtaza Rakhimov, has already appeared in the big redistribution, and among other contenders for the “inheritance” are large local entrepreneurs and numerous family members.
The Eighteenth Arbitration Court of Appeal recognized the results of the auction for the sale of a 99 percent share in the authorized capital of Bashkiria LLC as legal. Thus, the decision of the Arbitration Court of Bashkiria, made in October last year, has been annulled.
The specified share previously belonged to a well-known entrepreneur in the republic, Marcel Yusupov, who was declared bankrupt. “Bashkiria” is a co-owner of Park City Ural LLC, a legal entity of the Park city apart-hotel located on Mendeleev Street in Ufa. The remaining 1% in the capital of the LLC belonged to the businessman’s nephew Denis Yusupov – his recognized insolvent back in 2019 according to Sberbank.
Litigation
The auction for a 99% share in Bashkiria LLC took place in October 2022 and, at first glance, was of a formal nature. The starting price of the lot was 14.5 million rubles. For the possession of this asset, the appearance of a struggle was portrayed by Investtorgi LLC (according to available information, it represented the interests of Legal Center MAAT LLC, the entrepreneur Balasha Balashova – one of Yusupov’s creditors) and the second co-owner of Park City Ural LLC Fidan Yapparov. First contender offered per lot is 150 million rubles, the second is twenty times less – 7.3 million.
In this situation, Investtorgi was expectedly recognized as the winner, and in March 2023, the corresponding agreement was signed with the subsequent transfer of funds.
However, then something interesting began to happen: Fidan Yapparov challenged this decision in the Arbitration Court of Bashkiria. He insisted that the signing of the contract occurred with a significant delay in the terms specified in the auction documentation, and therefore the purchase and sale agreement should be declared invalid. Moreover, with such a development of events, Yapparov himself should be recognized as the winner of the auction due to the absence of competitors.
The arbitration court supported this opinion, citing the fact that the Federal Law “On Insolvency” establishes clear deadlines for concluding contracts with the winning bidders: seven days for sending a purchase offer and another five days for making a decision.
This decision was appealed to the 18th Arbitration Court of Appeal by the MAAT Legal Center and Uralkapitalbank, another creditor of Marcel Yusupov. Their appeal turned out to be successful – this authority ruled that a long term for concluding a contract cannot be a basis for its termination. It is also known from the file of arbitration cases that during the same period, MAAT tried to recover 160 million rubles from Park City Ural LLC and introduce interim measures prohibiting transactions for the alienation of hotel property, but suffered failures in two courts.
The bankruptcy case of Marcel Yusupov was accepted by the Arbitration Court of Bashkiria at the end of 2017, the Applicant then was Farmellinrus LLC, whose founders, according to Seldon Bas, included the aforementioned Balash Balashov. The insolvency application was granted in September 2018.
“Divorce” through divorce
Yusupov’s business career began during his student years. It is known that at the Faculty of Civil Engineering of the Chelyabinsk State Technical University he studied in the same class as the future governor of the region Mikhail Yurevich. They graduated in 1992, and three years later, according to some media reports, Yusupov was brought in as a defendant in a case of contract murder. Allegedly, it was about an “order” for a local businessman Vladimir Musorov. True, the case against him was closed, and all the information deleted from the Ministry of Internal Affairs bases.
However, a threatening background with a criminal flair and connections may have helped the entrepreneur achieve success and resolve issues in his future career. He was never again accused of serious crimes – perhaps because his opponents themselves felt when it was worth backing down.
In 2004, Yusupov became deputy general director of Pamir CJSC, where the only shareholder was a businessman Sergey Melekhin, who was called a close friend of Mikhail Yurevich. The next year, the latter became the mayor of Chelyabinsk, the prosecutor’s office was perplexed as to how Pamir received land for development projects without bidding, and soon a “big construction war” began in the city, as it was called called local media.
The next stage of Yusupov’s life was already connected with Bashkiria. Here he built the Iremel shopping and entertainment complex on the site of the Ufa Cotton Mill and repurposed the Ufa Knitting Factory into the Arkaim-Expo furniture store, acquired a dairy plant and two farms, and later began to actively go into the hotel business – this is how the already mentioned appeared in the place of Tourist “Park City”
In addition, in 2007, Yusupov was elected to the State Duma and will remain there for two convocations.
Shortly before bankruptcy, amazing things happen in the life and property of an entrepreneur. He is divorcing his wife Natalia Kryuchkovato whom, according to the contract, part of the property goes, marries Alina Kadyrova, and transfers part of the assets to it. And soon both wives begin to transfer the resulting property to other relatives – children and parents.
It is known that the volume of financial claims of creditors against the entrepreneur in the bankruptcy case reached $8.7 million, and the bankruptcy trustee was not very successful had tried return these assets to the general mass.
Too many namesakes
Some assets of Marcel Yusupov have already been put up for auction. For example, the aforementioned “Iremel” ultimately got it de facto former head of Bashkiria Murtaza Rakhimov for 746.6 million rubles. Other properties, including Park City and Bashkiria, have also been tried more than once sell. Already known to us “Investtorgi” by Balash Balashov in April 2023 purchased 59% in the authorized capital of Arkaim-Expo LLC for 122 million rubles.
A local businessman is also buying up Yusupov’s assets Regina Dormidontovashe is already won competition for a 35% share in NPRS Taimen LLC and 100% in TD LLC “Bashkir Bird”. Interestingly, according to Seldon Bas, until March last year, she was the owner of Alliance LLC, whose co-owner today is Fidan Yapparov, and is also the owner of RGSM LLC and the former owner of Aquacity LLC, where, among other owners at different periods time was listed Gulnara And Diana Kadyrovs – namesakes of Yusupov’s current wife. Are these games a continuation of attempts to redistribute property among numerous relatives?
Perhaps a big redistribution awaits Marcel Yusupov’s empire, in which the former head of the republic has already appeared, and in which, in addition to large entrepreneurs, the wives of the bankrupt businessman are planning to take part. Will this not end in yet another criminal showdown and the MIA’s databases being cleaned out, as has already happened in the career of this authoritative business man?
