Back in 2019, it was believed that the Saratov IP Ilya Sharom was very lucky: he acquired the property complex of OJSC Volgograd Shipbuilding Plant (OJSC VSZ) at an auction for 323.9 million rubles. The company has been bankrupt since 2012, and in 2018 the sale of its property began.
Initially, a single lot, which included buildings, land, and all equipment, from cranes to machine tools, was put up for sale for 2.7 billion rubles, but after a series of price cuts, in April 2019, the Saratov IP went to the plant with a big discount.
In Volgograd, Ilya Shary was unknown before this deal, but in Saratov, this businessman was noted in a number of high-profile cases, among which was the bankruptcy of CJSC Saratov Aviation Plant. During the bankruptcy of SAZ, Shary represented the interests of the Monolith-S company, which acquired the right to claim a debt of 336 million rubles from the aircraft plant and opened the way for SRO AU Liga. “League” and destroyed in 2012 the Saratov “strategist” and began to work closely on another member of the List of strategic enterprises of the Russian Federation – a shipbuilding plant in Volgograd.
The name of Ilya Sharogo is also known to criminal proceedings in the Saratov region – he was a witness in the case against the ex-head of Engels, Mikhail Lysenko. He talked about how he was engaged in a legal analysis of the transaction for the acquisition of the Lazurny shopping center, which in 2006 was bought from developers by the Moscow company Premier Finance.
In addition, Triumvirat LLC (Lazurny shopping center in Engels) attracts attention, Tatyana Sharaya acted as a co-owner of the company until April 2016. Tatyana Sharaya was also among the founders of the infamous Saratov LLC Bely Sokol, which tried to build high-rise buildings on the slope of Sokolovaya Gora near the airport, which would hopelessly ruin the panoramic view of the city.
Ilya Shary was registered in Saratov as an individual entrepreneur with the main activity “purchase and sale of real estate” literally a month and a half before the Volgograd transaction, on March 6, 2019. It should be noted that for years another well-known character in Saratov was leading the bankruptcy of the plant in Volgograd and putting up property for sale – a member of the SRO AU “Liga” Sergey Lyzhenkov, who had previously been expelled from the procedure at the Saratov plant of instrumental devices.
The pearl of the lot of the shipyard was, no doubt, the right to lease municipal land plots with an area of 136,381 square meters. m and 428,797 sq. m. Volgograd City Hall tried to remove these 55 hectares from the bankruptcy estate, but the arbitration court did not allow.
Moreover, as it turns out, these hectares were chosen during the bankruptcy proceedings by the Raduga Zinc List company, which is registered in Volgograd, but its founder and general director according to open data is He Ligan. Apparently, these are the same “Chinese” to whom, according to rumors, Shary could sell the plant for at least a billion for 2 billion rubles.
But everything turned out differently. Already in May 2019, the Federal Tax Service of Russia applied to the Arbitration Court of the Volgograd Region with an application to recognize the auction as invalid, in June the Committee for the State Protection of Cultural Heritage of the Volgograd Region applied to arbitration with a similar application.
Three months later, in August, the arbitral tribunal declared the auction and the sale and purchase agreement invalid, ordered IP Shary I.A. to return to the bankruptcy estate of the plant part of the property already transferred to the buyer, and also restored the businessman’s right to claim against OJSC VZZ in the amount of 102.9 million rubles. This decision stood in all instances, the appeal to the Supreme Court gave nothing to Sharom and Lyzhenkov.
The Volgograd Arbitration Court saw Shary’s affiliation and interest as a member of the creditors’ committee and as a person protecting the interests of the manager Lyzhenkov. The court of appeal also revealed Shary’s actual interest in relation to the secured creditor, the offshore Timkor Consulting Limited. Moreover, it turned out that the faithful friend of the League transferred only 102.9 million rubles to the plant’s account, and closed the rest by offsetting counterclaims with the participation of the very offshore Timkor Consulting Limited.
Meanwhile, as it later turned out, the Chinese comrades, in anticipation of the very auction from which Shary bought the plant, turned out to have transferred an advance payment in the amount of 70 million rubles to the future owner on account of a future deal, during which they would acquire some property from Shary.
In 2022, it became completely clear that neither money nor property could be expected from a businessman. It all ended in a lawsuit to the Arbitration Court of the Saratov Region, moreover, in the amount of 140 million rubles, since the Rainbow Zinc List company decided to double its claims. Then, in 2022, the regional arbitration fully satisfied the claims of the plaintiff. the appeal, but did not comply with the order of 12 AAC to pay the fee and inform the parties, and therefore the complaint was not considered.
Troubles haunt Sergei Lyzhenkov as well. It turns out that he was removed from the procedure for the Volgograd enterprise back in 2019, and then lengthy proceedings initiated by the tax authorities dragged on. Among them were claims under Lyzhenkov’s contract with Raduga Zinc List LLC dated 2019, where the company leased property to the company on unfavorable terms, and even with the provision of rental holidays.
During the proceedings, a criminal case emerged, initiated by one of the district prosecutor’s offices of Volgograd in 2020. Prosecutors found out that construction is in full swing on the territory of the bankrupt, and there are even foundations filled with concrete with reinforced foundations. It turns out that Lyzhenkov allowed the company “Rainbow Zinc Sheet” to work and make inseparable improvements. All this ended for Lyzhenkov with a criminal case under Part 1 of Art. 195 of the Criminal Code of the Russian Federation and the verdict that has entered into force.
And in March 2023, the cassation court of arbitration upheld all decisions of the previous stages regarding the work of Lyzhenkov (failure to take measures to preserve property, failure to issue invoices for rent) as the bankruptcy trustee of VZZ OJSC.
Since November 2019, Ivan Kalyapin from the Siberian Guild of Anti-Crisis Managers has been conducting the procedure at the VSZ. During this time, he challenged the deals carried out under his predecessor six times.
