According to Kommersant, 3,281,041,979 rubles. The Prosecutor General’s Office jointly and severally expects to recover from Igor and Andrey Pushkarevs, Andrey Lushnikov, as well as Spasskcement JSC, DV-Cement LLC, Crushing and Screening Plant JSC, Vladivostok Crushed Stone Plant JSC, Teploozersky Cement Plant JSC, Teploozersky Cement Plant JSC, “Spassky plant of asbestos-cement products” as the amount of unjustified income under contracts concluded in 2008-2015 with MUE “Roads of Vladivostok”.
As a result of checking Igor Pushkarev’s compliance with the requirements of federal legislation when concluding contracts for the purchase of building materials for municipal needs, the supervisory authority revealed facts of a cartel conspiracy between the ex-head of the city and the Vladivostok Roads institution previously subordinate to him with the companies of his brother (Vostokcement group of companies).
As a result of the collusion, at least 90 contracts were concluded and more than 3.2 billion rubles were received from them,” the Prosecutor General’s Office noted.
The supervisory authority explained that Mr. Pushkarev did not report the conflict of interest that had arisen due to family ties in the prescribed manner. The leaders and shareholders of the companies of the Vostokcement group also kept silent about the corrupt conflict of interest with Mr. Pushkarev and did not take measures to resolve it. “For providing assistance, Pushkarev received 75 million rubles as a bribe,” the supervisory authority specified, adding that, at the suit of the regional OFAS, the Primorsky Territory Arbitration Court recognized that the transactions were concluded as a result of a cartel. In its ruling, the Supreme Court of Russia pointed out that the agreements were concluded with the personal interest of the head of the administration of Vladivostok and “pursued a common economic interest.” At the same time, the contracts themselves were not advanced, and the bank guarantees provided for them did not meet the requirements.
Due to the fact that Igor Pushkarev and the heads of commercial organizations violated the prohibitions and restrictions established by law, according to the supervisory authority, all funds received under contracts are subject to collection in the income of the Russian Federation. “The filing of this lawsuit is aimed at compensating for the damage caused to the state and society, as well as preventing unjust enrichment of officials,” the Prosecutor General’s Office explained, noting that Igor Pushkarev himself did not declare the income received from transactions.
Protection of the ex-mayor of Vladivostok has so far refrained from commenting. “Pushkarev was not sued. Without knowing its content, it would be incorrect to give an assessment, ”lawyer Alexander Vysotsky told Kommersant.
Recall, on April 9, the Tverskoy District Court of Moscow found Igor Pushkarev, his brother, CEO group of companies “Vostokcement” Andrey Pushkarev and ex-head of MUP “Roads of Vladivostok” Andrey Lushnikov. The ex-mayor was sentenced to 15 years in a strict regime, his brother, an invalid, to 8 years probation, and Mr. Lushnikov received a 10-year sentence. All three also have to pay a fine of 500 million rubles. In addition, Igor Pushkarev is prohibited from holding leadership positions for ten years after serving his sentence. A civil claim filed by the Prosecutor General’s Office for the recovery of 143 million rubles was satisfied against him. in favor of the company “Roads of Vladivostok”.
The court found that, as the mayor of Vladivostok, Igor Pushkarev from 2009 to 2015 for bribes prevented other organizations from participating in municipal competitions for road construction. According to the investigation, Igor Pushkarev received an illegal reward of 50 million rubles from his brother through an intermediary Lushnikov. In addition, Vostokcement paid for the protection of the head of the city and various work carried out in his homes in Primorye and the Moscow Region, spending more than 25 million rubles on this.
The victory in tenders was ensured by the municipal unitary enterprise “Roads of Vladivostok”, having signed contracts with it for 1.2 billion rubles. for the supply of materials produced by the Vostokcement family group of companies. As a result, according to the investigation, close relatives of the mayor received 471.7 million rubles from these companies.
The defense of Igor Pushkarev has already appealed the verdict, the date of the appeal is still unknown. The ex-mayor maintains his innocence. “I believed and believe that I did everything right. I consciously took risks running the companies I owned through my family members, because otherwise I would not have been able to achieve the goals that I set for myself after being elected mayor. I spent my personal funds and the funds of my family for the benefit of the city, ”the ex-head of Vladivostok wrote on his page on the social network after the verdict was announced. He claims that Vostokcement did not receive a profit from the interaction with the Municipal Unitary Enterprise “Roads of Vladivostok”, but “a loss of more than 700 million rubles.”
