To consider the application of the First Deputy Prosecutor General Anatoly Razinkin, the Nikulinsky Court of Moscow needed only a few meetings. The requirements of the control to recognize as miserable the orders of the Federal Agency for State Property Management on securing 52 real estate objects on the right of economic management for FSUE Ateks FSO were fully satisfied, and the objects themselves were turned into the income of Russia.
According to the editorial staff, we are talking about 2 buildings at 45 Novoslobodskaya Street, 8 apartments and rooms, as well as 10 non-residential premises, also basements on Mira Avenue, buildings in the Throat Dead End (Tverskoy district of Moscow), as well as a number of buildings in Lyubertsy near Moscow. Their cadastral price is estimated at least 1.3 billion rubles.
The Prosecutor General’s Office learned about the “illegal withdrawal from the state ownership” and its “assignment” to FSUE “Ateks” with the “corruption help of the former management of this company” while supervising the investigations being carried out against a number of FSO employees and businessmen associated with them.
FSUE Ateks was first organized under the Ministry of State Property of the Russian Federation, but then transferred to the FSO. The main task of his work was the creation of products, the implementation of work, the provision of services in the interests of state security bodies; assistance in the development of their programs and projects, as well as the implementation of the functions of a general contractor. The bottom line is that the FSO itself could not engage in commercial work, due to the fact that the military serves in it.
During the period from 1999 to 2007, the Federal Property Management Agency transferred residential buildings, administrative and office buildings, a hotel, a hostel, a garage economy and warehouses, which are located in the capital of Russia and Lyubertsy, to the operational management of the FSO. In 2008, under the patronage of the head of the Forum holding, Dmitry Mikhalchenko, his partner Andrey Kaminov was appointed manager of the Federal State Unitary Enterprise. As it should be from the materials submitted to the FSO for supervision, he was the initiator of the withdrawal from the operational management of the special subdivision of real estate and its assignment to FSUE Ateks. To this end, Mr. Kaminov prepared a report addressed to the then acting head of the FSO, Yevgeny Murov, on the unproductive use of state property in the special service. Based on the results of its study, the objects on the right of economic management were assigned to the Federal State Unitary Enterprise.
In the future, according to the lawsuit, the FSO, reacting to violations in the use of property, “took measures” according to its return, but Mr. Kaminov actively interfered with this.
And this was connected, according to the General Prosecutor’s Office, with the fact that the disputed objects were used by Mr. Kaminov and his deputy Stanislav Küner “in the commercial interests” of Mr. Mikhalchenko and persons controlled by him. For example, according to the results of the auction, which was held by Mr. Küner, the premises on Novoslobodskaya Street and in the Gorlovy Dead End were rented by Synergy LLC, affiliated with the head of the Forum, until the end of 2026. Another 6 LLCs were assigned to the founders of Synergy, which are under the control of Mr. Mikhalchenko.
At the same time, Synergy “dragged the disputed property into the shadow economic sector”, “illegally transferred it” to XXI Century LLC, United Travel Center LLC, Document Preparation Center LLC and other structures controlled by Mr. Mikhalchenko “for their extraction illegal income.
And also, from 2008 to 2014, Messrs. Kaminov and Kuener concluded 23 municipal contracts with the Federal Security Service of the Russian Federation and 28 work contracts with companies controlled by Mr. supply of products at the facilities of the special forces. According to them, the companies that were part of the oligarch’s holding received over 33 billion rubles.
At the same time, in September 2021, by the decision of the capital arbitration, FSUE Ateks was recognized as groundless. In relation to the debtor, a competitive creation has been opened, the possibilities of its manager and other management bodies have been completed.
At the same time, the prosecutors established that “as a result of the malicious behavior of the defendants, the bankruptcy estate included not the property of the perpetrators of illegal enrichment and ruin, but the property of the country from which it was illegally withdrawn as a result of their corruption agreement.”
The defendants in the prosecutor’s lawsuit, Mikhalchenko and Kaminov, are currently being held in the Lefortovo pre-trial detention center. Together with former employees of the FSO, they are being tried on charges of organizing an organized criminal group (Article 210) for the fraudulent embezzlement (Article 159 of the Criminal Code) of 1.3 billion rubles. and repair work of objects in the residence of the head of the Russian Federation in Novo-Ogaryovo. Mr. Küner, who concluded a pre-trial agreement on cooperation in the same case, was sentenced in a special order to 8 years, which he is serving in colony No. 3 of the Kursk region. Previously, its prisoners produced parts for ZIL vehicles, and at the moment, zucchini, ducks and geese are grown in the main.
To protest or not the decision of the Nikulinsky district court, which fully satisfied the prosecutor’s statement, all the defendants have not yet decided. At the beginning of the proceedings, they protested against the fact that Judge Aigul Shaikhutdinova was replaced by Elena Kuznetsova due to illness, believing that she could form a certain attitude towards the defendants.
Last year, she satisfied the anti-corruption application of the General Prosecutor’s Office of Russia to Mr. Mikhalchenko and others by confiscating the St. Petersburg deep-water port of Bronka. After his own detention, the head of the Forum transferred the asset to the wife of the former head of the FSO, Yevgeny Murov, and retired general of the Federal Security Service Nikolai Negodov, trying to save him from seizure.
