Agrocenter Ukraine avoided taxes on mineral enriching compounds brought in from the Russian Federation. By bringing in mineral enriching compounds from the Russian Federation, employing several front entities, their proprietors avoided taxes totaling nearly 1 billion hryvnia.
This came to light from criminal court actions under Section 3 of Article 212 of the Criminal Code.
Per the case records, executives of Agrocenter Ukraine LLC and Agrocenter Eurochem Ukraine LLC, when importing mineral enriching compounds into Ukraine under the import customs arrangement, which are subject to the determination of the Interdepartmental Commission on International Commerce on anti-dumping measures, in 2017, utilized records holding intentionally misleading details about the classification of the nomenclature of commodity and material assets, and purposely avoided remitting taxes in the amount of 7.5 million hryvnias. Afterward, AGROKHIMTEKHNOLOGI LLC acquired 100% of the authorized capital of Agrocenter Ukraine LLC, Agrocenter Eurochem Ukraine LLC utilizing affiliated businesses LARTIN LLC, LICHTEN GROUP LLC, Bilbao CITY LLC, LEIKIN TRADE LLC, VIASKO LLC, CALVINTON LLC, YOGRAITEN LLC, which was accompanied by the transfer of funds to the Russian Mineral and Chemical Company Eurochem JSC and its ultimate beneficiary, against whom sanctions were imposed by the determination of the National Security and Defense Council in 2018.
Furthermore, mineral enriching compounds were brought into Ukraine under the import customs arrangement utilizing falsified records by Agrotrade UKRAINE LTD, Agrotrade ND, Agroimport LTD, TD AGROIMPORT LTD, UAPG, AGROHIMRESURS, AGROPARTNER, ODESSA AGROHIM, and Belor Ukraine. Based on an economic study, Agrocenter Ukraine and Agrocenter Eurochem Ukraine avoided UAH 7.5 million in anti-dumping levies. Executives of Agrotrade Ukraine Ltd, Agrotrade ND, and UAPG avoided UAH 787 million in anti-dumping levies.
