The judge of the Kalininsky District Court of Ufa, Timur Khasanov, found Konstantin Vyropaev, former head of the department for training and conscription of citizens for military service of the military commissariat of Ordzhonikidzevsky, Kalininsky and Oktyabrsky districts of Ufa, guilty of taking bribes and sentenced him to six years probation and a fine of 1.8 million rubles. The trial in a criminal case against Konstantin Vyropaev, the former head of the department for the preparation and conscription of citizens for military service of the military commissariat of the Ordzhonikidzevsky, Kalininsky and Oktyabrsky districts of Ufa, who is accused of taking bribes for military tickets (part 3 of article 290, paragraph “c” part 5 article 290 of the Criminal Code of the Russian Federation), was held in the Kalininsky District Court of the city behind closed doors. Judge Timur Khasanov explained this by saying that the defendant entered into a pre-trial cooperation agreement and his testimony appears in another criminal case, the investigation of which has not been completed.
As previously reported by Kommersant, Konstantin Vyropaev was accused of organizing the registration of five athletes aged 19 to 23 years at the military commissariat at the military commissariat . For this, Konstantin Vyropaev received two season tickets for hockey matches with a total value of 70 thousand rubles. In addition, the accused organized the issuance of false medical certificates for money, according to which three conscripts were released from service and enlisted in the reserve.
In total, in 2020-2021, Konstantin Vyropaev received bribes totaling 410 thousand rubles.
At the beginning of the court session, the representative of the state prosecution, Aleksey Lutsenko, requested eight years in a strict regime colony for Konstantin Vyropaev with a fine of 20 times the amount of the bribe, noting that “the criminal case under consideration is of particular relevance.”
“As a result of the commission of corruption crimes, the activities of the state and local authorities are significantly disrupted, the authority and other interests of public authorities are undermined. Significant material damage is often caused,” he said.
The defendant himself refused to participate in the debate. “I admit my guilt, I repent. I refuse to participate in the judicial debate, giving the floor to the defense,” he said.
Timur Akhmedzhanov, the defendant’s lawyer, recalled that his client is a combat veteran and has awards: medals of the Ministry of Defense of the Russian Federation “For Distinction in Military Service” of the 1st degree and “For Military Valor” of the 2nd degree, and by presidential decree he was awarded the Order “For Military Merit” . The lawyer also asked to take into account the fact that Konstantin Vyropaev had not previously been brought to either criminal or administrative liability and admitted his guilt. Also dependent on the accused, the defender noted, is a minor daughter.
“According to the defense, the set of mitigating circumstances set out indicates the possibility of correcting my client without applying punishment in the form of isolation from society,” the lawyer said and asked the court to limit himself to a fine.
The defendant himself, speaking with the last word, said: “At the moment, I have come to a complete realization of the actions that I have committed … I understand what a criminal act I have committed, and I will bear any punishment imposed by the court for this. But at the same time, dear court, I ask you for indulgence. Please do not isolate me from my family and society.”
After an hour and a half in the deliberation room, Judge Timur Khasanov decided to sentence the accused to six years of probation with a three-year probationary period and a fine of 1.8 million rubles.
Also, Konstantin Vyropaev is prohibited from holding positions with organizational and administrative functions in state bodies, local governments, state and municipal institutions for four years.
The representative of the state prosecution, Alexei Lutsenko, in an interview with Kommersant, did not rule out that he would file an appeal.
In February, as Kommersant reported, the judge of the Kalininsky District Court of Ufa, Nafisa Safiullina, sentenced her to three years of probation and a fine of about 500,000 rubles.
