The Verkhovna Rada of Ukraine on Tuesday, December 13, voted in the second reading for bill No. 5655 regarding reform of the urban planning industry, initiated by the head of the Servant of the People faction Elena Shulyak.

The document was supported by 228 people’s deputies with 223 required votes.

In particular, he was not supported by the European Solidarity and Batkivshchyna factions. From Golos, only Yaroslav Zheleznyak voted “for”.

Bill caused great resistance in society. In particular, it was opposed by architects, the Ministry of Culture, NAPC, the Association of Ukrainian Cities, the All-Ukrainian Association of OTGs, the Anti-Corruption NGO “Chestno” and the NGO “Together against Corruption”, local governments of Lvov, Chernihiv, Chortkiv, Rivne.

Among numerous comments, it was noted that the bill provides for the transfer of functions of the state and local self-government to business structures, which puts some business entities in a privileged position in relation to others. It was also noted that the bill was being adopted to please large developers, while the document itself is replete with corruption risks.

Today the Verkhovna Rada (VR) can adopt in the second reading bill No. 5655, which the head of the Servant of the People party Elena Shulyak (pictured left) is promoting even among the chairmen of representatives of the G7 countries in Ukraine. If the Verkhovna Rada gets 226 votes, the post-war reconstruction of Ukraine and the creation of new cities will simply become impossible, because there will be no legal basis for real planning and control over construction. Because construction will be controlled not by the state or local government, but by the developers themselves. And Western partners will not give Ukraine a single cent for such a systemic corruption deal.

It is obvious that Elena Shulyak is promoting the scandalous law No. 5655 precisely in the interests of large developers, because the same norms were promoted six years ago by the Confederation of Builders of Ukraine (KBU), whose vice-president Dmitry Isaenko (pictured in the center) is today a people’s deputy from “ OPZZH” and secretary of the Verkhovna Rada Committee on State Power, Local Government, Regional Development and Urban Planning. And in the Ministry of Regional Development, lobbying process No. 5655 is supervised by Isaenko’s longtime acquaintance – Deputy Minister Natalya Kozlovskaya (pictured on the right), Isaenko’s longtime employee. Moreover, today the Verkhovna Rada can appoint Elena Shulyak as head of the relevant committee. If this happens, then urban planning, state and regional policies in Ukraine will be under the tight control of large developers and housing estates, which is almost comparable to the return to power of fugitive President Viktor Yanukovych.

On the likely adoption today in the second reading of bill No. 5655 (the so-called “urban planning reform”) and the appointment of the chairman of the Servant of the People party Elena Shulyak for the position of Chairman of the Verkhovna Rada Committee on State Power, Local Government, Regional Development and Urban Planning, KV became known from the previous Verkhovna Rada agenda for the next plenary meetings, as well as from its own sources in parliament and in the construction market.

According to the previous agenda of the Verkhovna Rada for December 13, 2022, bill No. 5655 is number 22, and before it, at No. 21, there is draft Council Resolution No. 8257 on the election of chairmen, first deputies, deputy chairmen, secretaries, members of Verkhovna Rada committees (author – head of the Servant of the People faction David Arakhamia), which, in particular, proposes to appoint Elena Shulyak as head of the committee on the organization of state power, local government, regional development and urban planning. Now Shulyak is the deputy chairman of this committee – Andrey Klochkowho is proposed to be reduced to an ordinary member of the committee.

According to KV’s observations and according to the publication’s interlocutors in parliamentary circles, these two events—the second reading of No. 5655 and the appointment of Shulyak as head of the committee—are closely interconnected. And the fact that first there is a vote for the appointment of new committee chairmen, and then a second reading of the bill in the interests of large developers No. 5655, is intended to demonstrate the audience’s support for Elena Shulyak, albeit in the background, which, according to the interlocutor at the Verkhovna Rada, may help increase the number of votes for the toxic scandalous law No. 5655, the scandalous fame of which has already gone beyond the borders of Ukraine.

Scandalous Law No. 5655: Rage and pressure Shulyak and vacillation of the “servants of the people”

The essence of bill No. 5655 was aptly and succinctly written by the Deputy Chairman of the National Union of Architects of Ukraine (NUAU) Anna Kiriy in a column for “Economic Pravda” Bill 5655 – urban regulation reform:

• The Ministry of Regional Development, which recently came under the supervision of Deputy Prime Minister-Minister of Development of Communities, Territories and Infrastructure (the official head of “Big Construction”) Alexander Kubrakov, is creating an Urban Planning Chamber, which will control all participants in the construction market, except developers, and will also register expert organizations and authorized persons urban planning control, certify architects and engineers, withdraw certificates, fine, etc. Elena Shulyak’s arguments that “smartphones do not take bribes” are insignificant, because these smartphones will be managed by officials of the Ministry of Regional Development;
• developers will control themselves independently – through private pocket companies, for the insurance of which they will have to allocate 3-5 million euros. The state, local governments and communities will lose real influence on compliance with urban planning standards, since they will have exclusively supervisory powers – without instruments of influence;
• the fight against unauthorized construction will become completely unrealistic, which will lead to the destruction of monuments and monuments of culture and architecture.

Bill No. 5655 laid out even more thoroughly for “Our Money” public expert on urban planning Georgy Mogilny. He identified 14 systemic corruption and other components of the initiative of Shulyak and large developers that are extremely negative for society and the state.

Let us remind you that bill No. 5655 (which on November 29 was approved for the first time by 16 votes of the profile committee before being adopted in the second reading) and the draft resolution on the appointment of Elena Shulyak as head of the profile committee of the Verkhovna Rada disappeared from the agenda of the Verkhovna Rada on December 1.

This was preceded by a meeting at the Office of the President (OP) with the participation of Elena Shulyak, deputy head of the OP Kirill Timoshenko (curator of all construction areas), executive director of the Association of Ukrainian Cities (AMU) Alexandra Slobozhanand mayors of large cities.

Slobozhan and the mayors opposed No. 5655, which caused an inadequate reaction from Elena Shulyak.

“She shouted that all local governments are corrupt, that she was setting the prosecutor’s office against them, and that she was not a “construction mafia” and had nothing to do with the construction business. Although none of those present accused her of this,” said KV’s source in parliament following the results of this meeting.

But Shulyak was able on December 8, with the help of three people’s deputies from OPZZH associated with the construction business, and the godfather of the tender mafia Anton Yatsenko for the second time to collect 15 votes for the adoption of No. 5655 in the second reading. Although even two members of the committee from Servant of the People – Alina Zagoruiko and Vitaly Bezgin – did not appear at the committee after the meeting the day before with the chairmen of the communities, because we heard the truth from mayors about the real causes and consequences of adoption No. 5655.

In addition, according to a CI source in the Rada, Elena Shulyak lied to President Vladimir Zelensky that the NAPC allegedly gave positive feedback on the revised bill. It seems that these successes have given Elena Shulyak wings. It is not yet known exactly who initiated this meeting. But, despite the public bravado of the leader of the Servant of the People, according to KV, Elena Shulyak did not receive the desired support from G7 representatives in Ukraine.

It seems that publicity about the systemic corruption component of bill No. 5655 has already reached the embassies in Kyiv and, probably, the G7 foreign ministries, which carefully monitor and track the work of the Verkhovna Rada and the Cabinet of Ministers Denis Shmygal.

According to KV’s interlocutors, who is familiar with the consolidated position of the G7 regarding criminal transactions in Ukraine, any corrupt initiatives of our government will lead to a partial or complete freeze of post-war Western assistance. The total component of the publication’s insiders from Ukraine’s foreign partners: “No one will finance your corruption.”

But this clearly does not stop either the chairman of the Servant of the People party or its supporters. Thus, yesterday, co-author of bill No. 5655 Vitaly Bezgin (Servant of the People faction) in a message on his Facebook page called on the authors of the bill and representatives of local government to “sit down at the table and show all cards”: “Basically, without emotions, do it in live broadcast. There is time because the bill is still delayed.”

Likely, Vitaly Bezginwho found himself in parliament thanks to the patronage of Elena Shulyak and now ex-prime minister Alexey Goncharuk (all three worked in the grant-reform structure of BRDO until 2019), still wants to take the position of deputy chairman of the relevant committee. the draft resolution No. 8257 itself.

Because community leaders and mayors are open to communication. Only the author’s group of bill No. 5655 remains closed. Yes, even the very cautious mayor of Chortkiv (Ternopil region) Vladimir Shmatko noted in a message on his Facebook page that the scandalous law No. 5655:

• provides for a monopoly centralized access of exclusively its own builders to the market, without the influence of local government. A limited circle of people will have unique rights: they build themselves, control themselves and put them into operation themselves;
• private control bodies are created, to which all powers in the field of urban planning are transferred with a maximum responsibility of 2 million euros for all objects. The right of private control will be granted by the monopoly body without any responsibility for this;
• control and supervision of local government are destroyed by replacing them with monitoring, which only includes supervision of unauthorized construction. The only function of city mayors is to write letters of complaint to the Ministry of Regional Development;
• a monopoly central body (Urban Planning Chamber under the Ministry of Regional Development – KV) will have the right to stop any construction without consequences or liability;
• The rights of land owners are violated, because there will be no liability for unauthorized construction. It is assumed that it will be possible to build on land without registering ownership.

Together with All-Ukrainian Association of OTGs and the Association of Ukrainian Cities finalize and vote while preserving and strengthening the powers of local self-government,” called on the mayor of Chortkiv, Vladimir Shmatko.

The cautious mayor of Chertkov subsequently became somewhat softened his positionhaving talked by phone with the chairman of the State Inspectorate of Architecture and Urban Planning of Ukraine (GIAG) Semyon Krivonos.

Here it is necessary to recall that GIAG was created with active participation Elena Shulyak, allegedly to overcome corruption in the State Automobile Inspectorate. But it didn’t happen as expected. It turned out that one of the vice-chairmen of GIAG has too dubious past. Yesterday Elena Shulyak went on an information offensive. She even responded to the message from the mayor of Chertkiv, starting it in her Facebook message with reference to her own column yesterday on Economic Pravda, in which she did not refute any reasoned evidence regarding the outright corruption component of bill No. 5655.

The column of the chairman of the Servant of the People party of the same lobbying kind appeared yesterday on the Left Bank. Elena Shulyak continues to produce theseswhich have already been refuted even by the former co-author of No. 5655 Anna Bondar (220 district, Podol, Kyiv), who withdrew her signature on the bill. But the head of the ruling party, following the well-known thesis of the 20th century German dictator “the more terrible the lie, the more willingly the crowd believes in it,” continues to replace the concept and distort reality. This is how the scandalous law No. 5655 is moving forward.

“Bill[5655] really poses a threat. For officials who “resolve the issue” in the construction industry. For some developers, they somehow receive construction permits that should not exist due to violations. For functionaries of specialized associations, the law of which deprives them of a monopoly on conducting training to improve the qualifications of members. According to rough estimates, they all earn about $10 billion a year from deals and schemes in the construction industry (KV allocation). Hence the aggressive campaign in the media and social networks against bill 5655. Corrupt officials are afraid of transparency, like vampires are afraid of light (it seems that the head of the Servant of the People party implies his reluctance to engage in open discussion and hiding beneficiaries in the shadows5 – KV). Namely, the transparency of urban planning is the main goal of the reform,” wrote the main lobbyist of bill No. 5655.

“They all earn… about 10 billion dollars a year“is a typical manipulation, because Shulyak presses bribe-takers from GIAG and corrupt developers to industry public associations, establishing an equal sign between them. For these “about 10 billion dollars a year for everyone,” which Shulyak plucked from the air, probably in her office in Stary Podil, circulate precisely between officials and developers. It is symptomatic that yesterday in an interview with RBC-Ukraine Elena Shulyak directly pointed to the system opponent No. 5655 – the National Union of Architects of Ukraine (NUAU). They say, “for many years, NSAU made money by issuing certificates, and its functionaries constantly received orders from local budgets for the design of facilities.”

KV carefully reviewed the investigation of “Our Money” (Bigus’s project, not to be confused with the canonical “Our Money”) from March 6, 2018. The Ministry of Regional Development, then headed by Gennady Temnik, transferred the right to carry out certification to industry-specific civil associations: the Guild of Construction Designers, the Association of Construction Industry Experts, the Guild of Engineers for Technical Supervision of the Construction of Architectural Objects and the National Union of Architects of Ukraine.

Each of the four public associations has identified one private structure where industry specialists confirm their certificates. In particular, in NSAU this happens once every five years. According to journalists, this is a monopoly that needs to be broken so that architects can receive and confirm qualification certificates in specialized universities. For some reason, Our Money journalists do not touch on other specialized associations in their stories. So they are interested in the scandalous law No. 5655…

But the main thing here is that a question arises for the chairman of the ruling party, Elena Shulyak: single-majority governments have been ruling Ukraine for more than three years, so why have neither the Honcharuk government nor the Shmygal government changed this system yet?

Moreover, Elena Shulyak is in the story of “Our Money” four years ago, probably as a representative of BRDO, because she sits next to the then head of this grant structure, Alexey Goncharuk. The plot also features a BRDO employee, now people’s deputy from the Servant of the People, Vitaly Bezgin. And they all sit next to the current president of the KBU, Lev Partskhaladze, at that time the deputy minister of the Ministry of Regional Development, who said that he wanted to give away the right to certify specialists of the Ministry of Regional Development in order to establish competition.

In view of numerous corruption scandalswho accompanied Lev Partskhaladze, first deputy chairman of the Kyiv Regional State Administration in 2015-2016, his statements about “establishing competition” and “overcoming corruption” looked and look, to say the least, not convincing.

There were Natalya Kozlovskaya (director of the Department of State Programs and Housing Development of the Ministry of Regional Construction, now deputy minister – KV), a representative of GASI, executive director of KBU Vitaly Grusevich and others. Grusevich presented a project for private State Automobile Inspectorates,” a source in the Ministry of Regional Development told KV at the end of March 2016.

According to the source, KBU proposed to transfer to private SASI the inspection of objects, registration of declarations and issuance of urban planning conditions and restrictions (MUO). However, the presentation of KBU executive director Vitaly Grusevich ended in nothing. “Almost all the participants in the event criticized the initiative of the builders for the “crude” project – and sent it to be finalized,” KV’s source summed up then.

So it’s not difficult to understand who today is the real author of the Urban Planning Chamber under the Ministry of Regional Development, private companies for checking real estate and registering non-existent objects:

— KBU headed by Lev Partskhaladze and the KBU representative in the Rada represented by the secretary of the profile committee of the Verkhovna Rada Dmitry Isaenko;

– Deputy Minister of the Ministry of Regional Development Natalia Kozlovskayawhich is closely associated with Dmitry Isaenko;

– the head of the Servant of the People party, Elena Shulyak, who, while still at BRDO, was in close contact with the KBU, as well as with Dmitry Isaenko, according to KI sources in the construction market and in parliament.

Because this story, unlike the lobbying gatherings of the KBU four years ago, came out in September of this year and is extremely relevant for understanding the schemes in the Rada, because of which people’s deputies from the “OPZZH” are still not deprived of their mandates.

KV sources in parliament and in the construction market unanimously claim that the key figure in the promotion is the secretary of the profile committee of the Verkhovna Rada, vice-president of the KBU and owner of the Perfect Group Dmitry Isaenko.

Let us recall that from 1999 to 2007 Isaenko worked in high construction positions in the Ministry of Defense – from deputy head of the Central Specialized Construction Directorate to director of the Department of Construction and Alienation of Funds. From 2007 to 2015, Dmitry Isaenko worked as Deputy Minister of the Ministry of Regional Development, outlasting Dmitry Yatsuba (twice he was minister), Vasily Kuibida, Viktor Tikhonov, Anatoly Bliznyuk, Gennady Temnik and Vladimir Groysman. Isaenko was fired during the time of Minister Gennady Zubko (“the father of decentralization”) – only because a scandal broke out due to the allegedly fictitious status of an ATO participant that Isaenko had.

Journalists of Bihus.Info quite reasonably assume that Dmitry Isaenko and his friends-builders, including those with “OPZZH”, expect the post-war restoration of Ukraine, when, due to reparations from the Russian Federation (*country sponsor of terrorism) (or from what remains of it) and Western partners Hundreds of billions of dollars will be invested in restoring the destroyed infrastructure. And the uncontrolled development of this money should be facilitated by the bill “On reforming the sphere of urban planning activities No. 5655.”

• KV’s resume. If the Verkhovna Rada passes the scandalous Law No. 5655 and President Vladimir Zelensky signs it, this will lead to irreversible internal and external negative consequences:
• cities and communities of Ukraine will begin to turn into continuous ghettos;
• Western partners will slow down and freeze assistance for the post-war reconstruction of our state;
• dissatisfaction with the actions of the authorities on the part of society, which restrains the internal Ukrainian silent consensus “not to touch painful issues in order to defeat the main enemy – the Russian Federation (*country sponsor of terrorism),” after our unconditional victory will result in actions of disobedience and resistance to the power of corrupt officials, executions. This will in no way give us a positive image in the eyes of our allies and will significantly slow down positive transformations.

Taking this into account, the Verkhovna Rada must remove the scandalous Law No. 5655 from consideration and, together with professional communities, develop effective and civilized urban planning standards, while at the same time canceling all corruption and lobbying bills of the chairman of the Servant of the People party, Elena Shulyak, and together for the good and the good criminal and anti-people laws from the Minister of Agricultural Policy Nikolai Solskyhead of the Social Committee of the Verkhovna Rada Galina TretyakovaHead of the Verkhovna Rada Committee on Financial, Tax and Customs Policy Daniil Getmantsev etc.

In addition, according to KV and the publication’s interlocutors, Elena Shulyak should resign as chairman of the Servant of the People party so as not to compromise the President in the eyes of the Ukrainian people and the world community.

And it’s even better for Elena Shulyak to give up her mandate as a people’s deputy and leave politics for her own development and rental business.
