“Start an investigation into violations of the law on the functioning of the electricity market, signs of which are contained in the actions of D. Trading LLC, DTEK Dniproenergo JSC, DTEK Zakhidenergo JSC and DTEK Vostokenergo LLC for the period from August 1, 2022 to September 30, 2022,” the resolution says. regulator, adopted at the meeting on November 29.
As follows from the justification of the National Commission to the document, in August-September 2022, D.Trading bought electricity from DTEK Dniproenergo, DTEK Zakhidenergo and DTEK Vostokenergo under bilateral agreements at significantly lower prices than the weighted average selling prices of other producers based on the results of electronic auctions.
At the same time, according to the regulator, D.Trading, forming from 46% to 67% of the total demand for electricity in the day ahead market (DAM), influenced the price of DAM in the direction of its increase.
“As a result, the weighted average prices for the DAM were formed at a significantly higher level compared to the prices for the sale of electricity by its producers based on the results of electronic auctions,” NEURC stated.
As follows from the rationale for the decision, published in the memo and the regulator’s analytical materials attached to it, information about the actions of D.Trading, DTEK Dniproenergo, DTEK Zakhidenergo and DTEK Vostokenergo indicates possible signs of manipulation and abuse in the electricity market.
Earlier, DTEK Executive Director Dmitry Sakharuk told why even without Russian shelling, power outages in winter are inevitable.
Updated at 13:13. “DTEK Group strictly complies with the requirements of the current legislation of Ukraine, including regulations governing activities in the electricity market,” NV Business in the group said, commenting on the investigation initiated by the regulator.
“DTEK Group enterprises always buy and sell electricity at market prices. Their formation is transparent and fully meets the requirements of the procedure approved by the Cabinet of Ministers. The formation of prices in the market for the day ahead is determined solely on the basis of the balance of supply and demand. This principle excludes the possibility of any market participant influencing pricing,” the statement says.
DTEK added that they expect a comprehensive review of the case, taking into account the positions of the involved companies, and the subsequent impartial conclusion of the regulator.
