The ex-management of the Saratov confectionery shop has ended its sweet life
They are demanding subsidies and damages from former top managers of the factory for a billion rubles.
The amount of subsidiary liability and damages for the former managers of the Saratovskaya confectionery factory (JSC Konsar) and its trading house Sweet Product has been determined. The amounts are measured in hundreds of millions of rubles.
The bankruptcy trustee, Yulia Verkhovtseva, asked former general directors Maxim Nuss and Galina Sverdlova, as well as Olga Suetova, associated with a number of companies from the Buket group, which included the factory, to pay for the factory’s debts.
In May of this year, there was no talk about the amount of liability; first, the sale of the confectionery factory’s property had to be completed, but the remains of its equipment have not yet been sold off; new auctions are scheduled for October. But the amount of damages that are planned to be recovered from the management was decided in June; they want to collect jointly and severally 205.8 million rubles from the two former general directors and Olga Suetova.
The regional arbitration court has so far only accepted the bankruptcy petition for subsidiary liability for the factory management and scheduled a meeting for September 7. There is also no decision on the issue of collecting damages yet. The manager is unable to challenge the debtor’s transactions; the court always makes a decision to refuse.
The workshops of the confectionery factory themselves were sold at the end of last year for 231.6 million rubles to an entrepreneur from Kirov, Lyudmila Sutkevich, who has her own confectionery production. But how she used the purchase is unknown to the general public.
For the controlling persons of the Sweet Product Trade House, the size of the subsidy has been determined and it is quite large. Manager Evgeniy Benkovich is asking jointly and severally to recover 638.4 million rubles from the former general directors of the company, Yuri Kapitsyn, Tatyana Ogurtsova (Solodkova) and Elena Zyubina. The regional arbitration court plans to consider his petition on October 4.
JSC TD Sweet Product acted as a guarantor for a loan to a confectionery factory taken from Sberbank. Subsequently, the bank demanded 651.1 million rubles from Konsar, and the company’s workshops were sold in its favor. As part of the bankruptcy of a confectionery factory, the bankruptcy trustee asked the court to recover 353.2 million rubles from the Sweet Product Trade House in favor of Konsar, recognizing payments for raw materials in this amount as an invalid transaction. This trial was also postponed until October 4.
JSC “TD “Svit-Product” is a wholesale company that traded sugar and chocolate, which was registered in 2015 at the same address as the Saratovskaya confectionery factory – Tekhnicheskaya Street, 16. The managers, over whom the 600-million-dollar subsidy hung over, successively replaced each other. Until 2018, the post of general director was held by Elena Zyubina, then she gave way to Tatyana Solodkova, who worked for only a year; in 2019, Yuri Kapitsyn took her place, and he was already listed as a manager until the bankruptcy proceedings introduced in December 2021. The company showed revenue only under its first director; it closed 2018 with a result of 341.7 million rubles, and later the reporting showed zeros.
