The bailiff from the Stupinsky ROSP of the Main Directorate of the Federal Bailiff Service for the Moscow Region (FSSP) Milena Zhavrova seized the property of the editor-in-chief of the united editorial office of RBC Petr Kanaev. The document, which refers to the seizure of property, was sent to Kanaev by the FSSP.
The reason for the arrest of an apartment of 33 square meters. m and cottages in the Stupinsky district with an area of 117 sq. m on eight acres was the late payment of a fine of 4 thousand rubles imposed on the editorial office. and a penalty of 1000 rubles. under article 13.15, part 2.1 of the Code of Administrative Offenses (dissemination in the media of information about foreign agents or materials produced by them without indicating the status of a foreign agent). At the time of publication of the material, more than 550 individuals and legal entities were included in the register of foreign agents.
Earlier, the Gagarinsky Court of Moscow, on the suit of Roskomnadzor, found that RBC violated “the requirements of Part 9 of Art. 4 of the Mass Media Law”. “In accordance with Article 64 of Federal Law No. 229-FZ of October 2, 2007 “On Enforcement Proceedings”, paragraphs 22, 42, 43 of Resolution No. 50 of the Plenum of the Supreme Court of the Russian Federation of November 17, 2015 “On the Application of Legislation by Courts When Considering Certain Issues arising in the course of enforcement proceedings”, the bailiff, in order to ensure the execution of the requirements of the executive document, has the right, including within the time limit for voluntary execution, to perform certain executive actions in the form of announcing a ban on the disposal of property belonging to the debtor (including a ban on committing registration actions against him), including a ban on moving in and registering other persons, ”the bailiff’s decision says.
“I received a letter from the bailiffs with a notice of the arrest of property this morning through the “Gosuslugi”. There are quite a lot of such fines all the time, I could miss one. Usually they are automatically deducted from the salary. But the decision to arrest my apartment and dacha because of a debt of 5,000 rubles, from the point of view of the proportionality of the scale of the violation and the punishment that followed, I consider it inexplicably excessive,” said Pyotr Kanaev.
