Golovinsky District Court of Moscow on the suit of the Prosecutor General’s Office confiscated from the former deputy head of the cantonment and rear construction department of the High Command of the Internal Troops of the Ministry of Internal Affairs (VV, transformed into the Russian Guard), Colonel Igor Dolgikh five apartments.
According to the investigation, from 2006 to 2017, Dolgikh bought six properties in apartment buildings that were built for employees of the internal troops of the Ministry of Internal Affairs. At the same time, Dolgikh hid the fact of the purchase by registering five apartments and one non-residential premises for his sister Irina, and did not declare the property.
The audit revealed a discrepancy between Dolgikh’s expenses and his income. He could not prove the legality of the acquisition of real estate, and the investigation decided that he received it as a bribe. The fact of violation of anti-corruption legislation was revealed by the Investigative Committee during the investigation of a criminal case under Part 4 of Art. 159 of the Criminal Code (fraud committed by a group of persons or on an especially large scale or resulting in the deprivation of a citizen’s right to housing) due to the theft of budget funds allocated for the construction of apartment buildings to provide housing for employees of the Internal Troops of the Ministry of Internal Affairs.
According to Kommersant, a case was opened against Resentment Yasinov, who headed the Mosstroymekhanizatsiya-5 (MSM-5) company, which built the Leonovsky Park residential complex in Zheleznodorozhny near Moscow, consisting of six 17-storey skyscrapers, four low-rise buildings, and also built a kindergarten and two schools. The military invested almost 5.6 billion rubles in this project, for which 1678 apartments (more than 50% of the total construction volume) were to be allocated to them in the residential complex.
However, by the expiration date of the contract in 2016, the Russian Guard had not received about 400 apartments. Yasinov was suspected of fraud, and then accused of giving bribes (Article 291 of the Criminal Code) in the form of two apartments and non-residential premises to the then head of Balashikha Evgeny Zhirkov. Both sentenced to seven and nine years in prison.
Yasinov told the investigation that he also bribed Dolgikh in the form of five apartments and non-residential premises. The former employee of the Internal Troops of the Ministry of Internal Affairs was arrested until mid-April.
The arguments of the defendants that the property was acquired with legitimate income, the court did not accept, since the value of the assets is several times higher than the total legal income of the brother and sister. However, Igor and Irina Dolgikh did not provide evidence that the defendants’ legal labor activity brought them income that allowed them to acquire the disputed property. Irina Dolgikh’s arguments that she independently acquired real estate with her savings, as well as with money received from her parents, were rejected by the court, since loan agreements, deposits, cash receipts from the sale of property, donations of money, income statements, etc. she did not present.
Meanwhile, another court, Tushinsky, satisfied another claim by Anatoly Razinkin – against the owner of MSM-5 Obid Yasinov and the company’s chief accountant Alexander Gladyshev, recovering from them the damage caused by the crime. We are talking about the fact that the defendants, as well as the general director of the company Sergey Kachalin (claims against him were withdrawn, since the entrepreneur died) from September 2011 to July 2012 evaded taxes by 72 million 191 thousand rubles, concluding fictitious MSM contracts -5 with Profi LLC.
