At one time, she participated in many high-profile processes, but about two years ago she was convicted of fraud against her client. She herself considered her criminal prosecution the revenge of the special services for refusing to cooperate. At first, the 5-year sentence was suspended, but later the courts, having reduced the sentence by more than two years, made it real. Since then, Lukmanova's mother of many children has been trying to get a review of the sentence or a reprieve until the children reach the age of majority. Finally, she managed to get a reprieve in the Ivanovo Regional Court. Ms. Lukmanova herself still does not consider herself guilty and intends to defend her good name.
Last Wednesday, the Lyublinsky Court of Moscow planned to consider two cases at once involving Olga Lukmanova. The first meeting was devoted to her application for parole: she received the right to parole, taking into account the time served in the pre-trial detention center, recalculated according to the formula “a day in a detention center – a day and a half in a general regime colony.” “The hearing was postponed to another date, since Olga Lukmanova wanted to achieve precisely a postponement of the execution of the sentence – a norm that our courts practically do not apply,” Yuri Avdeev, Ms. Lukmanova’s lawyer, told Kommersant. After that, another meeting took place: the Ivanovo Regional Court considered an appeal against the decision of the Kineshma City Court, which six months ago refused to grant a deferral of execution of punishment to the convicted Lukmanova until the age of 14 by her five-year-old son, the youngest of her five children (Article 82 of the Criminal Code of the Russian Federation).
The process took place online via video conferencing, since in recent months Olga Lukmanova was not in a colony, but in the capital's SIZO-6 “Pechatniki”. According to Mr. Avdeev and his client, they had hope for a positive decision, since the judge “approached the case very responsibly”, studying and analyzing two volumes of documents submitted by the lawyer. And the prosecutor's office, as before, insisted on the need for the convict to serve the entire term in the colony, arguing that she had not embarked on the path of correction, had not admitted guilt, had no incentives, etc. Meanwhile, the administration of the institutions of the Federal Penitentiary Service, where Olga Lukmanova and whose opinion is important for the court, their representatives were not sent to the meeting. On the other hand, prisoners who were with the ex-lawyer, mostly former employees of state and law enforcement agencies, sent their appeals in support from the Pechatniki women's pre-trial detention center.
“As it turned out, the regional courts, in this case the Ivanovo Regional Court, are much more attentive to such petitions and to compliance with the current legislation of the Russian Federation than the capital’s courts,” Olga Lukmanova told Kommersant after the court ruled to grant her a deferment from execution
In fact, it is nine years, which absorbs both the term of the sentence and the time required to cancel the conviction and annul its consequences.
The court decision was subject to immediate execution, but the court could not immediately contact the pre-trial detention center due to the late time, Yury Avdeev explained, which is why the release was postponed to Thursday. Relatives had been waiting for Olga Lukmanova since morning, but due to bureaucratic delays, she left the pre-trial detention center only at about ten o'clock in the evening. “For me, the main thing was to be at home, with my family, to hug the children, many thanks to everyone who supported me all this time,” Olga Lukmanova told Kommersant. and Svetlana Shmelev, Deputy Chairman of the Duma Committee on Security and Anti-Corruption Anatoly Vyborny and, of course, Alexei Melnikov from the capital's PMC, whom I congratulate on joining the HRC under the President.” She stressed that she still does not consider herself guilty and intends to fight for her good name, as well as return to the profession as soon as possible. Her status was terminated due to conviction, but it can be obtained again by passing the exams. As Kommersant reported, many representatives of the legal community came to the defense of Mrs. Lukmanova, and about fifty well-known lawyers represented her interests in court.
“To get into the place of my clients myself is a difficult, painful and insulting experience, but it also made it possible to see “that world” from the inside, and how my family experienced this life stage will be printed in the book of my eldest daughter Daria, with publications in it photographs and documents and my personal experience, which, as it turned out, were accepted by some courts for the first time,” Ms. Lukmanova said. And in 2017, she herself was detained by FSB and ICR operatives, accusing her of deceiving her own client, a metropolitan district police officer, who was accused of a number of crimes. The lawyer has been under investigation for several years. Ms. Lukmanova insisted that she spent all the client's money through the accounting department, and did not give any promises to “resolve” his issues through contacts in the TFR. But in the end, the Izmailovsky District Court of Moscow sentenced her to five years probation, and the Moscow City Court of Appeal unexpectedly reduced the sentence to three years (later knocked off another two months), but made it real. The ex-lawyer was sent to a colony in Kineshma, where he was assigned to the garment industry. True, after three months they returned back to Moscow, to the pre-trial detention center to participate in the consideration of cassation complaints.
