Recently, The Moscow Post released an article called “CCHPYA Knutye and the Ministry of Internal Affairs”, which told about the story of the likely deception of one of the counterparties of the “Central Black Earth Industrial Company” (TsChPK) – SC “Agroservices” and the possible deliberate bankruptcy of TsChPK.
The story also mentioned employees of the Ministry of Internal Affairs who may be engaged in forging the signatures of their superiors in order to delay the criminal process against the CCHPK. The journalists came to the conclusion that this can be done in the interests of the CCPC itself and its other counterparties, to which, according to the materials of the court cases, the funds of the CCPC (including the CCFC) were transferred.
After the release of the material, we received explanations from the representatives of the CSPYAC, who appeal to the fact that delaying the case is rather beneficial for the Agro-services Group of Companies and associate what is happening with an attempt to take over the company for raiders. The correspondent of The Moscow Post understood the situation.
Everything is intertwined
Recall that the CPC is currently in the process of bankruptcy at the request of the State Corporation “Agroservices”. The supplier company did not receive full payment for its services. On the other hand, the money that could have gone to her went to pay for the supply contract between the CPC and the Econom-Service LLC company. As it was later established by the court, the contract was by no means concluded for the stated purpose, it was declared invalid (it is possible that in this way money was simply withdrawn from the CCPC to a possibly affiliated company, so that later it could have a preferential right to receive the debtor’s property when he leaves into bankruptcy).
At the same time, the court established the fact that the volume of cash payments by CCHPK to CJSC CCHPYAK for the period from 07/17/2017 to 12/31/2018 is 71.97% of the amount of all payments made for the specified period. The court also established the fact of abuse of the right of CJSC “CCHPYAK” in order to increase the controlled accounts payable from CCHPK.
As Sergei Ponomarev, the owner of Agrouslug, commented to Kommersant, the employees of the CSPNC and Mr. Litvinenko’s proxies (founder and chairman of the board of directors of the CCPNC Valery Litvinenko) are the ultimate beneficiaries of the CCCPP.
At the same time, let us remind you that now the CCPP is trying to recover 73 million rubles from the CCPC, to enter the register of the company’s creditors.
From this, we concluded that it was the Agro-services company that could be deceived in this story.
As for the forgery of the signature, it follows from the documents submitted to the Editorial Office that the signature of Major General Alexander Vokhmyanin on the documents authorizing the extension of the investigation is not real.
And the delay in the investigation of the criminal case on deliberate bankruptcy may be more beneficial to the CCHPK and its probable “affiliates”.
However, the CCPP has a different position.
“In support of my position, I explain that in connection with the conduct of investigative actions, all the property and accounts of the CCPSK (cash, non-residential buildings, refrigerators, land plots, warehouses) have been seized,” writes media specialist Pavel in support of the CCPSCC position. Due to the fact that the property of the CChPYAK was allegedly seized, the company has blocked all financial and economic activities and there is no way to start the necessary work in the gardens.
“These circumstances threaten the continued existence of the Central Chernozem Fruit and Berry Company and put it on the verge of closing. Therefore, neither the representatives of the company nor Valery Litvinenko are in any way interested in dragging out the investigation. Moreover, in connection with the falsification of documents by the representative of the Central -Chernozem Fruit and Berry Company” a statement was written addressed to the head of the Investigative Committee of the Investigative Committee of the Russian Federation for the Voronezh Region, Lieutenant General of Justice Levit K.Yu.
Who will outplay whom
If the investigation had not been dragged out, according to all the facts from the court cases, it turns out that the CCPP, with a high degree of probability, would still have to pay “Agro-services” the money due to it for the services provided by the CCPC. Either for TsChPYAK this should have been done by TsChPK or “Economy Service”.
However, if the CSPYAC goes bankrupt, “Agro-services” will be able to receive, if not money, but the company’s property, which in the future seems to be much more profitable.
From this point of view, it can be assumed that delaying the case is really more beneficial for Agro-services.
In total, we have: a group of companies headed by the CCHPK, which could try to enter a deliberate bankruptcy in order not to pay Agro-services its debts – on the one hand. And “Agro-services”, which may have decided to get from careless “colleagues” much more than what they are actually due. To be disrespectful?
And in this whole story, more recently, there is also the trace of the Ministry of Internal Affairs, which, apparently, “plays” on the side of one of the participants in the process. It seems that it is time for Mr. Kolokoltsev to put things in order in the department.
