The defendant considers the arguments of the investigation “a standard set of phrases.” At the trial, he insisted that the charges against him were formal, and all transactions with borrowers were checked by the security service of the Nizhny Novgorod bank.
The Nizhny Novgorod District Court began to announce the verdict to the ex-chairman of the board of Radiotekhbank Alexander Stepanov. The former banker was accused under Part 1 of Art. 201 of the Criminal Code of the Russian Federation “Abuse of authority” after the license of a credit institution was revoked in January 2019. According to the plot of the case, under the leadership of the accused, Radiotekhbank issued 1.8 billion rubles to three dozen organizations with signs of fictitious legal entities in 2018–2019. bad loans.
According to the investigation, some of the companies involved in the case, such as OOO Avtotekhnika, Hummingbird, Oil Company Barrel, Alternativa, Titan, Stroyservis and others, were registered as dummies. The founders and directors of the companies were alcoholics, the disabled, the unemployed and other nominees who signed documents for transactions. They were paid 5,000–20,000 rubles a month for the services of zits-chairmen, and many were interrogated in court by witnesses.
Among the borrowing organizations there were also companies specially acquired by attackers to withdraw funds from Radiotekhbank by obtaining non-performing loans, the investigation believes.
Hundreds of loan agreements were concluded with them for the replenishment of working capital or the purchase of equipment, but in some cases they could not provide collateral. Then other LLCs entered into guarantee agreements with them, to which the bank then assigned the rights of claim, increasing credit limits to borrowers. Moreover, as the examination of the investigation showed, additional agreements, agreements on the termination of loan agreements with the bank, guarantee agreements and other documents were signed not by the directors of these companies, but by unknown persons, imitating the visas of the leaders. million rubles, the bank notified the organization that it no longer met their requirements. The right to claim the debt was transferred by the bank to the guarantor, who prepared a fuel supply agreement for justification.
However, the second debtor did not pay off the bank as a result, the text of the verdict said. A similar scheme was applied to Stroyservis LLC, which had liabilities of 85 million rubles to the bank, they were transferred to another company, but the loan was not returned.
Some legal entities, according to the investigation, were engaged in misuse of loans. In particular, they borrowed money from Radiotekhbank to replenish working capital or purchase special equipment, and then, by proxy for nominees, they bought expensive Toyota, Porsche, BMW models in Nizhny Novgorod, Samara, Moscow, St. Petersburg and Ulyanovsk. As a result, the Central Bank drew attention to dubious transactions. The internal control service of Radiotechbank was recognized as ineffective, the regulator found violations in terms of combating money laundering.
In addition, a year before the revocation of the license, Radiotechbank was convicted of dubious transit operations and violations in attracting deposits.
Alexander Stepanov disagrees with the accusation of abuse.
“This is an unspecified standard set of phrases. There was a security service and a legal department of the bank that checked all transactions with borrowers. They signed that they were reliable firms, the bank divisions made a dossier, and they were approved by the credit committee. Earlier, in the arbitration case on the bankruptcy of Radiotekhbank, the DIA also demanded that a number of persons controlling it be brought to subsidiary liability in the amount of 5 billion rubles.
