The aviator lowered his wife on the “golden parachute”
An ex-manager and his wife were accused of trying to steal 50 million rubles from a manufacturer of tires for aviation. As it became known to Kommersant, in Yaroslavl the police are investigating a criminal case on an attempt to steal 50 million rubles. from YaShZ Avia LLC, the largest Russian developer and manufacturer of aircraft tires for aircraft and helicopters. According to investigators, it was planned to steal the company’s funds under the guise of paying a “golden parachute” under a fictitious employment contract.
The charge was brought against the former deputy managing director of YaShZ Avia, Kirill Vasilyev, and his wife, Zhaneta Stumbraite, who, according to the case file, was intended for the parachute. The Civil Court, meanwhile, dismissed Ms. Stumbraite’s claim for reimbursement of at least unpaid wages, pointing out in the decision that there was no evidence of the existence of her employment relationship with the plant.
According to Kommersant’s information, the former deputy managing director of the Yaroslavl YaShZ Avia and his wife were charged at the end of last year. The actions of the spouses were qualified by the investigation as an attempted fraud committed by a group of persons on an especially large scale (part 3 of article 30 and part 4 of article 159 of the Criminal Code of the Russian Federation). Moreover, Kirill Vasilyev was charged in absentia: the ex-manager living in the TiNAO, according to the investigation, disappeared and was put on the wanted list.
According to the investigation, and the case is being conducted by the Leninsky DMIA of Yaroslavl, the couple tried to steal 50 million rubles from YASHZ Avia. under the guise of paying Janet Stumbraite a “golden parachute”.
The events described in the case took place in 2020-2021. It should be noted that the enterprise recognized as the injured party is the largest Russian developer and manufacturer of aircraft tires, including those for military aircraft, helicopters and ground special equipment for the needs of the Ministry of Defense, the Federal Security Service and the Russian Guard.
According to the investigation, at the beginning of 2020, Mr. Vasilyev planned the scam, based on his knowledge of the peculiarities of the enterprise’s document flow and the presence of large sums of money in his accounts. Another important factor was Mr. Vasiliev’s trusting relationship with the then head of the enterprise, Boris Shalagin. He, as follows from the materials of the case, perceived Mr. Vasiliev as a representative of the owner of the plant and, in particular, consulted with him on personnel matters.
First, according to the investigation, at the direction of Mr. Vasilyev, a fictitious employment contract was made between YASHZ Avia and Mrs. Stumbraite. According to him, a woman was appointed to the position of Deputy Managing Director for General Affairs. At the same time, one of the clauses of the agreement provided that in the event of the dismissal of a new employee within ten years at the initiative of the employer, the enterprise would be obliged to pay him compensation in the amount of 50 million rubles. At the same time, it is noted in the case file that the position indicated in the contract was not in the staff list of the plant, and the terms of termination had not previously been found in the contracts of employees. At the same time, Zhaneta Stumbraite, who at one time, according to Kommersant, received the specialty of a dressmaker of women’s outerwear, did not have a higher education and since 1998 has not worked anywhere.
Be that as it may, the woman signed the contract, and the spouses, according to the case, “knew for certain” that the official duties set out in the contract would not be performed by her.
After that, in order to give the contract “legally significant force”, Mr. Vasilyev brought it to the signature of the managing director Boris Shalagin. And he, “misled” by his subordinates, signed the contract and the order for the appointment of Janeta Stumbright. The next day, the woman was paid an advance – 50 thousand rubles.
However, then there were changes in the management of the enterprise, Mr. Vasilyev left the plant, after which his wife was no longer paid a salary. On December 1, 2020, she demanded that the LLC pay off the debt in the amount of 300 thousand rubles, as well as interest for her delay. Having not received the money, “acting in concert” with her husband, the woman applied in March 2021 with a statement to the labor inspectorate, and also filed a lawsuit with the Troitsky District Court of Moscow. She submitted a contract to the court, which spoke of a “golden parachute”, apparently hoping, if she won, to demand then a multimillion-dollar compensation. However, in July 2021, she was denied, and the court indicated in the decision that the plaintiff did not provide evidence “reliably confirming” the existence of an employment relationship between her and YaShZ Avia. And during the investigation, it turned out that Janet Stumbraite did not apply for a job at the plant, which is why there is no corresponding entry in her work book. By the way, she herself later confirmed that she had never worked at YaShZ. As a result, the investigation concluded that the actions aimed at embezzling 50 million rubles were not carried through to the end due to circumstances beyond the control of the accused. At the same time, the spouses themselves do not admit guilt in attempted theft.
It is possible that a second episode may appear in the case. As it turned out, on May 14, 2020, Kirill Vasiliev entered into an employment contract with a company that is part of the YaShZ Avia group, which also includes a clause on the payment of a “golden parachute” in the amount of 50 million rubles. With him, the former top manager turned to the Zyuzinsky Court of Moscow, but he refused the lawsuit. The matter is under investigation.
Representatives of the injured party complained to Kommersant about the delay in the investigation.
According to them, in a year and a half, the investigators “completely restored the picture of the crime, collected all the necessary evidence,” however, there is “no talk” about getting acquainted with the case materials and its further sending to the court. Meanwhile, the defendants, according to representatives of the injured party, “begin to put pressure on witnesses, demanding that their testimony be changed.” In particular, Boris Shalagin complained about this. In connection with red tape, complaints were sent to the prosecutor’s office and higher investigative bodies.
