The name of the musician in the published message on the social networks of the department was not disclosed. According to a Kommersant-SPb source, we are talking about rapper Oksimiron (Miron Fedorov is recognized as a foreign agent in the Russian Federation). The prosecutor's office saw calls for actions aimed at destroying the territorial integrity of Russia in the artist's video for the song “Oida”. If the lawsuit is satisfied, the rapper faces a fine of up to 100 thousand rubles, and the video posted on his page on the social network VKontakte, according to lawyers, will be deleted.
The case of an administrative offense under Part 2 of Art. 20.3.2 of the Code of Administrative Offenses of the Russian Federation in relation to the rapper Oksimiron (recognized as a foreign agent in the Russian Federation) was sent to the Oktyabrsky District Court of St. Petersburg. According to this article, the artist faces a fine of 70 to 100 thousand rubles. However, according to Andrei Chertkov, Chairman of the Human Rights Commission under the Council of the St. Petersburg Bar Association, the article constitutes an administrative prejudice, which in the future threatens to bring the artist to criminal liability under Art. 280.1 of the Criminal Code of the Russian Federation for the repeated commission of the same administrative violation. The punishment in this case will be up to five years in prison.
They started checking the artist's creativity at the end of October. The Safe Internet League, headed by Ekaterina Mizulina, sent an appeal to the Prosecutor General's Office with a request to check the Oida track for signs of extremism. Ms. Mizulina saw calls in the song to separate St. Petersburg from Russia, and also considered it necessary to check the rapper himself for involvement in and organization of “extremist activities to split Russia on the basis of an interethnic theme.”
Already in early December, the Oktyabrsky District Court of St. Petersburg registered an administrative lawsuit from the prosecutor of the Admiralteysky district against the singer, Yandex, the social network VKontakte and the streaming service Sound, demanding that the above track be banned from distribution. The text of the track was studied by specialists from St. Petersburg State University. According to their conclusion, the artist positively assesses the separation of part of the territory of the Russian Federation. In addition, St Petersburg University experts saw in the text calls for “certain actions that could result in a violation of the territorial integrity of the Russian Federation.” The experts refer to a line that contains the words “rebuilding the house” (of the country), as well as to a statement in the form of a “slogan”, which, in their opinion, “demonstrates a positive public attitude towards the separation of part of the country.” The rapper's song also features the line “Ingria will be free.” (Ingria, also known as Ingermanlandia, is a historical region on the territory of modern Russia, St. creativity and evaluate works of art through the prism of criminal law or legislation on administrative offenses directly contradict Article 44 of the Russian Constitution. “This article, up to the present time, guarantees citizens the freedom of literary, artistic and other creativity.
