The former deputy head of the land and property relations department of the administration, Eduard Sardarov, managed to recover 600 thousand rubles from the Russian Ministry of Finance, represented by the Federal Treasury Department for Bashkiria. In this amount, the Kirovsky District Court of Ufa assessed compensation for non-pecuniary damage for illegal criminal prosecution in 2018 on charges of abuse of power. According to Mr. Sardarov, he experienced moral suffering due to repeated searches and the measure of restraint chosen for him. The Kirovsky District Court of Ufa partially satisfied the claim of the former deputy head of the land and property relations department of the administration, Eduard Sardarov, against the Russian Ministry of Finance, represented by the Federal Treasury Department for Bashkiria, to recover 1.5 million rubles. compensation for non-pecuniary damage caused during criminal prosecution. As Kommersant-Ufa previously reported, in 2018 a criminal case was initiated against Eduard Sardarov on charges of abuse of power. According to the investigation, Mr. Sardarov and the head of the department of land and property relations, Rail Enikeev, unreasonably reduced the debt for the lease of land to the Rosevrodevelopment-Ufa company (manages the Planet shopping center). In July 2019, the criminal case was dismissed due to the lack of corpus delicti. Messrs. Sardarov and Enikeev were recognized as having the right to rehabilitation.
In July 2019, Eduard Sardarov resigned from the department of land and property relations. He is currently a lawyer.
Eduard Sardarov went to court at the end of July. In the statement of claim, he indicated that, due to the preventive measures applied, he experienced moral suffering, which was aggravated by the use of bracelets for electronic tracking. During the investigation of the criminal case, the official was under house arrest for more than two months (from July 17 to September 27, 2018), after which the preventive measure was changed to prohibit certain actions for five months.
The ex-official also indicated that mental suffering was caused by repeated searches at the workplace, where he held a senior position and had a “significant number of employees” under his command. Searches also took place at the official’s place of residence, which, according to him, increased suffering due to the use of a service dog, and his two minor children and elderly parents became witnesses of these actions. At the same time, he “experienced a sense of shame due to participation in investigative actions as attesting neighbors,” the text of the lawsuit says.
Mr. Sardarov also asked the court to attach to the case file a list of publications on the topic of his criminal prosecution, since he experienced “humiliation of dignity as a conscientious and law-abiding citizen” due to the dissemination and discussion of information in society. The plaintiff also pointed out that the notice of the planned indictment caused damage to his health. In June 2018, Eduard Sardarov was admitted to City Hospital No. 18 with a diagnosis of “transistor ischemic attack”.
Last autumn, the Sovetsky District Court of Ufa satisfied a similar claim by Rail Enikeev and collected 600,000 rubles from the Russian Ministry of Finance, represented by the Bashkir Department of the Federal Treasury. (see Kommersant-Ufa of November 10, 2022). Mr. Enikeev, like his former subordinate, asked to pay him 1.5 million rubles.
The department of the federal treasury of Bashkiria did not answer the call of Kommersant-Ufa.
Eduard Sardarov told Kommersant-Ufa that he did not plan to appeal the court’s decision.
“When I went to court, I wanted to achieve justice and restore my reputation and good name. The moral damage caused cannot be compensated for by any amount of money,” he said.
