Rosprirodnadzor received 37 million from the assets of the Asbest City Hall for harm to nature
The Arbitration Court of the Sverdlovsk Region upheld the claim of the Ural Interregional Directorate of Rosprirodnadzor in a case of environmental pollution. The defendant was MKU “Vtorresursy” of the Asbestovsky urban district. The plaintiff demanded 37 million rubles, according to the file of arbitration cases.
The state company is engaged in the disposal of municipal solid waste (MSW) at the landfill. From the beginning of 2020 to the end of 2021, the enterprise emitted pollutants into the atmosphere without permission. At the same time, MKU “Vtorresursy” Asbest paid for environmental damage, but at a reduced rate. After the inspection, the Ural Department of Rosprirodnadzor requested the maximum compensation from the company: it was necessary to pay an additional 35 million rubles. The government agency refused. In the argument, the defendant stated that he tried to obtain a permit for emissions, but three projects were not approved.
“The department refused to approve the standards for maximum permissible emissions due to the presence in the project of incomplete, unreliable and distorted information, as well as the lack of a dispersion calculation made taking into account the background,” the case file says.
The arbitration court sided with the plaintiff. The final amount of compensation was 37 million, which also included the amount of the penalty.
Let us clarify that the director of the municipal government enterprise “Vtorresursy” of the Asbestovsky urban district is Irina Kamkina. The founder is the Asbest municipal property management department. The company has not made a net profit for several years. In 2021 and 2022, the loss amounted to 24 and 25.7 million rubles, respectively, according to the Kontur.Focus system.
