The Ural Bank for Reconstruction and Development (UBRD) and VUZ-Bank became participants in major financial conflicts related to car dealerships, in particular, in the Moscow region. Demands for hundreds of millions were presented by bankers to the company “Avanta_ZK” from Khimki near Moscow. At the same time, the offshore asset of Kermina Trading Ltd, the Central Bank of the Russian Federation and the interregional department of Rosfinmonitoring for the Urals Federal District were involved in the proceedings, and in one of the disputes allegations of falsification were already made and a handwriting examination was appointed. Merchants and UBRD also clashed in the bankruptcy case of the capital’s Invest-M, probably related to Avanta_ZK. In the process, not only the transfer of hundreds of millions to a company from the UK was sorted out, but also the compensation, according to which several car dealerships were given at once. Now transactions with a foreign company have already been studied by the courts of several instances, and they did not recognize them as invalid. Meanwhile, the parties are preparing for new disputes worth hundreds of millions, and insiders talk about likely attempts to “wear down financiers in lengthy and numerous debates,” while businessmen are attracted to “subsidiaries” and led through bankruptcy proceedings.
PJSC “Ural Bank for Reconstruction and Development” (UBRD) in the Arbitration Court of the Sverdlovsk Region requires to recover more than 150 million rubles from LLC “Avanta_ZK” (Khimki). As follows from the documents, we are talking about obligations under a series of loan agreements.
Kermina Trading Ltd, OOO Central Committee Sheremetyevo, the Central Bank of the Russian Federation and the interregional department of the Federal Financial Monitoring Service for the Urals Federal District (Rosfinmonitoring) have already been involved in the proceedings as third parties. It should be noted that the defendant especially insisted on attracting an offshore company.
In addition, VUZ-Bank JSC (part of the UBRD group) also announced its intention to recover more than 99.6 million rubles from Avanta_ZK. It is noteworthy that in the case the merchants have already made a statement about falsification – as a result, an examination was appointed, which should examine the authenticity of Vladimir Gennadievich Ivanov’s signature. The latter, according to Kontur.Focus, is a member and CEO of a firm from Khimki.
According to the sources of the publication, if inconsistencies are found in the documents, some of them may be excluded from the evidence base, while, according to insiders, the supervision at the moment allegedly “did not find violations on the part of financiers.”
Pravda UrFO also contacted the press service of the Ural Bank for Reconstruction and Development, in which they provided explanations regarding the conflict situation. “In 2018, loan agreements were signed between UBRD and Avanta_ZK, as well as VUZ-Bank and Avanta-Zapad LLC (currently declared bankrupt. – Note ed.). Two months later, Avanta_ZK accepted the debt under the loan agreement from Avanta-Zapad <…> Within the established time limits, LLC did not fulfill its obligations <…> and did not pay the debt. It was not possible to collect it in pre-trial order. <…> UBRD and VUZ-Bank filed a lawsuit <…> Currently, the processes are ongoing, including the collection of additional evidence in these court cases,” the bank’s press service said.
It should be noted that, according to the information of the Kontur.Focus system, the main activity of Avanta_ZK is related to the trade in motor vehicles. Similar data is placed in the card of the aforementioned Avanta-Zapad LLC. The latter, judging by open sources, positioned itself as a Hyundai dealer. As follows from the Kontur.Fokus database, the registration authority in relation to Avanta_ZK made a decision on the upcoming exclusion of the legal entity from the Unified State Register of Legal Entities.
Avanta_ZK and UBRD also appear in another trial – the bankruptcy case of Invest-M LLC (Moscow). Note that the aforementioned Vladimir Ivanov was previously listed as the director of a capital company. In addition, “Avanta_ZK”, “Invest-M” and “Avanta-Zapad” in different periods are united by the surname of Alexander Alekseevich Makeev, who is now also going through bankruptcy proceedings.
The Invest-M case is noteworthy, in particular, for its large claims and real estate objects. Thus, the court considered an agreement under which Invest-M transferred car dealerships worth more than 249.8 million rubles in favor of UBRD as compensation for the obligations of Avanta_ZK. As follows from the documents, in particular, it was about a land plot of 7,000 square meters, an ABK building, a Renault building, and a General Motors building.
In addition, transactions with Sebright Finance Ltd (Great Britain) were considered in the process, which were initially declared invalid, as a result of which the foreign company received claims for more than 699.5 million. However, the decision was canceled on appeal, and then to the same conclusions came cassation. It should be noted that at the moment, in the Invest-M case, the claims of UBRD-Finance for more than 787 million are stated. However, as the interlocutors of the publication note, they can be changed against the background of the above disputes.
