Today, in the Gagarin court, the verdict was announced to a group of young people who participated in the so-called Gelandewagen races on Leninsky Prospekt. The son of the Vice President of LUKOIL Ruslan Shamsuarov (20 years old) and his friend Viktor Uskov (25 years old) were found guilty of insulting police officers (Article 319 of the Criminal Code of the Russian Federation) and sentenced to 300 hours of compulsory work. Another defendant in the criminal case, Abduvakhob Majidov (22 years old), was completely acquitted by the judge. The SUV Mercedes Gelandewagen, driven by Abduvahob Majidov, was confiscated in favor of the state.
In addition, the Gagarin court acquitted Ruslan Shamsuarov, Viktor Uskov and Abduvakhob Majidov precisely on the part of the charge that threatened them with imprisonment: under Part 1 of Article 318 of the Criminal Code of the Russian Federation (threat of violence against a representative of power). Earlier, the prosecutor asked to sentence Ruslan Shamsuarov to 2 years 1 month in prison under this article, Abduvakhob Majidov to 2 years 1 month in prison and Viktor Uskov to 2 years 7 months in prison. “The court concludes that the actions of the defendants under this article are erroneously qualified, since they are fully covered by article 319 of the Criminal Code of the Russian Federation,” said judge Olga Zeldina.
At the same time, she listed the insults that the racers made against the police for a long time, and also recounted the conclusions of the linguistic examination. “The phrase “sat on a stick” belongs to Shamsuarov. According to the examination, from the phrases “sit on a stick”, “whom will you sit on today”, we can conclude that the traffic police officer should have sexual intercourse with his staff today,” the judge said. This and other phrases “have a negative connotation” and “defame the honor and reputation of the police”, and the defendants tried to “show their superiority.” “Deviant behavior is seen in the actions of the defendants,” the judge concluded.
Ruslan Shamsuarov’s defense was satisfied with the court’s decision on the episode with the use of violence against the policeman. “That accusation was initially delusional and it is fundamentally important that the court figured it out,” lawyer Mikhail Dolomanov told reporters. He added that the issue of filing an appeal will be resolved after a conversation with his client.
Meanwhile, the state prosecution has already declared its disagreement with the verdict. “The state prosecution is dissatisfied with the verdict and will appeal it after receiving it,” the prosecutor said.
Recall that the scandalous incident occurred on May 22 in Moscow on Leninsky Prospekt and Kosygin Street. Abduvakhob Majidov, who was driving the Mercedes Gelandewagen G63 AMG SUV (owned by Ruslan Shamsuarov), defiantly violated traffic rules: he exceeded the speed limit, drove into the oncoming lane and sidewalks. The passengers of the car conducted a live video broadcast of what was happening through Periscope from the passenger compartment, expressing various insults to the police officers on the air. Abduvahob Majidov deliberately provoked traffic police officers to chase, as a result, the SUV tried to catch up with six patrol cars. When the car was stopped, the driver and passengers tried to escape, but the police detained them, filed violations and let them go home. A little later, Ruslan Shamsuarov himself apologized on his Facebook page for the behavior of his friends.
The incident received a wide public outcry. First, the traffic police inspectors compiled several administrative materials regarding the driver (running a red light, driving in an oncoming lane, etc.). But after the head of the Moscow police, Anatoly Yakunin, sharply demanded tougher measures from his subordinates in order to “put an end to lawlessness on the part of the golden youth,” tougher measures were also used. Abduvakhob Majidov, for example, was assigned 200 hours of compulsory work for driving without a license, and also deprived him of his license for driving into an oncoming lane. In addition, together with Ruslan Shamsuarov and Viktor Uskov, he was sentenced to administrative arrest for disobeying the police. In addition, the investigation several times tried to qualify the actions of young people as hooliganism, but the prosecutor’s office opposed this. It is interesting that by the time of consideration in court, the fact of traffic violations by the race participants faded into the background: young people were already considered, in fact, as violators of public peace.
The trial itself lasted several weeks. At one of the hearings in the Gagarin court, Abduvakhob Majidov said that he began to leave the police after one of the inspectors threw a baton at him.
Kommersant FM correspondent Pyotr Parkhomenko from the courtroom: “It is absolutely true that in the end Mr. Majidov was completely acquitted – the one who was driving this Gelandewagen. To be honest, I and many colleagues who are present here have some bewilderment about this, because it is not very clear why, out of all those present in the salon, one person turned out to be completely innocent of anything.
