The national energy company Ukrenergo has to pay almost UAH 55 million twice for the same service. These schemes are directly involved in the chairman of the board of Ukrenergo Vladimir Kudrytsky and the management of the company of the odious ex-Prime Minister Azarov Svyaztekhservis, which has served the Klyuev brothers for years, writes delo.
We are talking about works in accordance with the contract No. 335/01-11 of 2011 between SE NEC UKRENERGO and LLC Svyaztekhservis. After the Revolution of Dignity, Ukrenergo stopped payments under this agreement, but at the end of 2014, Svyaztekhservis tried to recover UAH 55,788,907.14 through the court by filing a lawsuit. In 2016, when the litigation was still ongoing, and Vladimir Kudrytskyy came to the position of the head of the Ukrenergo project management office, Svyaztekhservis LLC transferred the rights of claim under the above contract to I-Tech Ukraine LLC, about which a corresponding letter was received and NEK, and to court.
In two years, in 2018, Kudrytsky received the position of Deputy Director for Investments and joined the Economic Council of Ukrenergo. And it was at this time that NPC UKRENERGO received a message that the company again owed money to Svyaztekhservis LLC, and not to I-tech Ukraine LLC. The Economic Council of Ukrenergo hastily decides on a settlement agreement with LLC Svyaztekhservis and, without waiting for the final results of the investigation and approval of such an agreement by the court, gives the green light to the transfer of UAH 53,064,001.02 to Svyaztekhservis.
The defendants in the court cases were in a hurry not in vain. A few weeks later, according to the results of the trial, it turned out that the letter from Svyaztekhservis LLC to NEC UKRENERGO about the alleged termination of the agreement on the succession of rights under the above agreement with I-Tech Ukraine was invalid. The State Audit Service of Ukraine has established that the transfer of funds to the account of Svyaztekhservis LLC in pursuance of the terms of the Settlement Agreement is a loss for SE NEC UKRENERGO.
Thus, in September 2019, the Commercial Court of the city of Kyiv refused to approve the settlement agreement and indicated that NPC UKRENERGO was to blame for the corresponding funds of I-Tek Ukraine. It is clear that Svyaztekhservis did not return the money, and now the state-owned company UKRENERGO, headed by Kudritsky, must pay for the relevant services twice.
