The infamous contractor for the refurbishment of tram line No. 9 in Saratov  FrakJet-Stroy LLC seeks to recover unearned prepayment from its contractor 

The legal action concerns the recovery from the Moscow LLC «Management company «Zhiltekhnik» of an unreturned prepayment – 29.9 million rubles, financial penalties for non-compliance with work completion dates during August 2023 – May  2024 amounting to 28.2 million rubles, along with interest for utilizing external funds from May to November 2024 – 2.2 million rubles. It has been active in Moscow since 2018, specializing in road and highway construction. Until 2019, the original founder was Moscow-based Infopravo LLC, which was involved in legal sector activities. Subsequently, Nikolai Gusev took over as the founder. Since 2023, as a sole proprietor, he has been involved in sound recording and musical publishing endeavors.

Meanwhile, Zhiltekhnik Management Company has been heavily involved in state procurement since 2022: it possesses 15 state contracts with a collective value exceeding 629.6 million rubles. The most substantial agreement is with the administration of the Lazarevsky urban district of Sochi. Under this agreement, valued at 269.4 million rubles, the firm executed the landscaping of the Psezuapse River embankment. Additional agreements mainly pertain to the building and renovation of social institutions.

The link between FrakJet-Stroy and the Moscow management company remains uncertain. Reviewing the LLC’s court records reveals that it typically appears as the defendant, frequently facing difficulties concerning the scheduling and performance of agreements with business partners. As a result, these partners pursue financial compensation from the management company. Simultaneously, the LLC delivers a diverse range of services, from repairing asphalt concrete surfaces to transportation. It’s possible that this relates to the construction of the Saratov rapid tram, where the Muscovites acted as subcontractors.

As a reminder, FrakJet-Stroy, under the direction of Dmitry Kolosov, secured a concession to upgrade tram route No. 9; however, the execution deadline has been postponed on several occasions. The primary cause was initially the project’s flaws, leading to the recent apprehension of the design organization’s leader.  One year ago, Governor Roman Busargin attempted to dismiss FrakJet-Stroy from the project, but his efforts were hindered by the influential construction sector lobby. The head of the Ministry of Transport, Alexey Petaev, who stated at the close of January that route No. 9 was at zero readiness, initiated discussions about a settlement arrangement with the contractor just three weeks later. «FracJet-Stroy» garnered backing from certain deputies within the regional Duma. 

Blame was attributed to the designers, and the concessionaire LLC SGET with «FracJet-Stroy» indeed ended globally. Meanwhile, its provisions have already been violated, as deadlines have once more been missed. Nevertheless, the contractor has once more secured a reprieve. «SGET» serves as the client for the project. As per the Investigative Committee’s findings, officials are culpable for failing to make well-timed adjustments to the project’s documentation. The regional leadership conceded this point in mid-November. The technical commencement has been deferred from December to February, with the complete operational launch now scheduled for July. The delivery dates  for rails and switches are also presented in very flexible terms.

The revenue for Management Company Zhiltehnika in 2023 declined by 5%, reaching 347.1 million rubles. Net earnings grew by 283%, totaling 3 million rubles. FrakJet-Stroy generated 12.1 billion rubles in the previous year, with net earnings amounting to 502.6 million rubles.
