– 02 May 2023 new head of the investigative department of the TFR for the Republic of Bashkortostan colonel of justice Arkhangelsky Vladimir Vladimirovich filed a criminal case No. 1230280005000030 on the grounds of a crime under Part 1 of Art. 285 of the Criminal Code of the Russian Federation, in relation to the ex-deputy head of the Beloretsk MSO of the Investigative Committee of the ICR for the Republic of Bashkortostan Fazletdinov Artyom Maratovich.
The implementation of the preliminary investigation of the criminal case was entrusted to the head of the second department for the investigation of particularly important cases of the investigative department.
The decision to initiate a criminal case was made personally by the head of the investigative body of the TFR for the subject of the Russian Federation due to the fact that Fazletdinov A.M. the status of a lawyer, which, in accordance with the criminal procedure law, requires a special procedure for the production of a criminal case.
According to the investigation, Fazletdinov A.M., who served in the period from 2014 to 2021 in the TFR, was appointed from September 11, 2017 to the position of deputy head of the Beloretsk MSO of the investigative department, being an official endowed in accordance with the provisions of the Code of Criminal Procedure of the Russian Federation with organizational -administrative functions, committed abuse of official powers under the following circumstances.
Fazletdinov A.M. On February 08, 2018, being in the building of the Beloretsk MSO of the Investigation Department, at the address: Beloretsk, st. Lenina, d. 47, intentionally, from a different personal interest, expressed in the deliberate creation of conditions for criminal prosecution Danyanova R.R.., on the basis of personal hostility to the latter, knowing that Danyanov R.R., a crime under Art. 319 of the Criminal Code of the Russian Federation, did not commit against him, using his official position and the powers provided in accordance with the Code of Criminal Procedure of the Russian Federation, compiled and registered in the KURSP of the Beloretsk MSO a report on the discovery of signs of a crime, indicating in it information that does not correspond to reality that Danyanov R.R. . On February 8, 2018, in the evening, while in the premises of the Beloretsk MSO, he publicly insulted him with obscene language, in connection with which, in the actions of Danyanov R.R. signs of a crime under Art. 319 of the Criminal Code of the Russian Federation, according to which it is necessary to conduct an audit in accordance with articles 144-145 of the Code of Criminal Procedure of the Russian Federation.
After that, Fazletdinov A.M. continuing his criminal actions, during the period from February 12 to February 15, 2018, being at his workplace, knowing in advance that the report compiled by him on the basis of false information was registered in the CURSP of the Beloretsk MSO and checked in accordance with Art. 144-145 of the Code of Criminal Procedure of the Russian Federation on the indicated fact is carried out by the head of the Beloretsk MCO Ishbulatov I.S.., received on behalf of Ishbulatov I.S. explanations from two citizens, making in the protocols of explanations deliberately false information that the latter are eyewitnesses of how Danyanov R.R. publicly insulted the deputy head of the Beloretsk MSO Fazletdinov A.M. in the performance of their official duties.
In addition, Fazletdinov A.M., in the period from February 08, 2018 to April 07, 2018 in the building of the Beloretsk MSO, gave an illegal instruction to a subordinate employee – the investigator of this MSO Suleimanov N.R. about giving false explanations, that in the evening on February 08, 2018 at the time of the arrival of Danyanov R.R. in the Beloretsk MCO, in the premises of the MCO there were two guys, which Suleymanov N.R. was fulfilled.
On April 16, 2018, the head of the Investigative Department for the city of Uchaly, who, at the direction of the head of the Investigation Department, organized a procedural check on the fact of publicly insulting Fazletdinov A.M., who was not aware of the criminal actions of Fazletdinov A.M. Fazleletdinova A.M. verification material, a criminal case No. 11802800026000022 was initiated against Danyanov R.R. on the grounds of a crime under Art. 319 of the Criminal Code of the Russian Federation.
As a result of criminal actions Fazletdinova A.M. aimed at artificially creating information about the involvement of Danyanov R.R. to the allegedly committed crime, on April 16, 2018 in relation to Danyanov R.R. a criminal case No. 11802800026000022 was initiated on the grounds of a crime under Art. 319 of the Criminal Code of the Russian Federation, thereby significantly violated the rights and legitimate interests of Danyanov R.R., provided for by the Constitution of the Russian Federation, and he was subjected to illegal and unreasonable criminal prosecution.
By the verdict of the Beloretsk Interdistrict Court dated May 29, 2020, Danyanov R.R. acquitted on charges of committing a crime under Art. 319 of the Criminal Code of the Russian Federation, on the fact of insulting Fazletdinov A.M., since the court concluded that there was no evidence of this.
