Both were accused under Part 4 of Art. 159 of the Criminal Code of the Russian Federation (fraudcommitted by an organized group or on an especially large scale), Golovinsky - also under Part 3 of Art. 286 of the Criminal Code of the Russian Federation (abuse of power with causing grave consequences). Both also became civil defendants in a claim for the recovery of damage caused to the enterprise JSC GKNPTs im. M.V. Khrunichev” in the amount of 19,108,747 rubles. 72 kop. According to investigators, Dolgushin and Golovinsky, who are cousins to each other, entered into a criminal conspiracy aimed at embezzling funds belonging to JSC GKNPTs im. M.V. Khrunichev”, allocated within the framework of the federal target program for the development of the military-industrial complex of the Russian Federation for 2011-2020. — for the modernization of equipment located on the territory of the Polet Production Association. In the period from May 5, 2016 to March 12, 2018, acting jointly and in concert, deliberately, out of selfish motives (at the same time, Dolgushin used his official position by deceit and abuse of trust), they committed, not having intentions to fulfill contractual obligations in full, theft funds belonging to JSC GKNPTs im. M.V. Khrunichev”, in a particularly large size.
We are talking about contracts for various construction and installation works as part of the technical re-equipment of the Omsk enterprise for the production of Angara launch vehicles. According to the investigation, Golovinsky convinced Dolgushin to participate with his JSC Sibsma in the procurement of JSC GKNPTs im. M.V. Khrunichev” in the person of the software “Flight” to conclude these contracts “in order to obtain maximum profit, and then by deceit to evade the fulfillment of obligations.” Part of the work was carried out in accordance with local estimates, part was deliberately not completed or performed in a smaller volume using a smaller amount of materials:
“Golovinsky, hiding the fact of his kinship with Dolgushin, in order to transfer funds belonging to the Polyot enterprise in favor of Dolgushin, took control over the performance of the work of Sibsma JSC, preventing other specialists from the Polet software from accepting work” .
At that time, Golovinsky was the technical director at the enterprise. According to investigators, he persuaded Mikhail Ostroushenko, head of the Polet software company, to sign fictitious acts of acceptance of work performed in the forms KS-2 and KS-3. On April 5, 2017, Golovinsky himself became the director of the enterprise - Ostroushenko was disqualified for five months due to a gross violation of the terms of the state contract, but continued to work at the enterprise as an adviser to the director.
The Oktyabrsky District Court, composed of Svetlana Morozova, found Sergey Dolgushin guilty of committing fraud committed by an organized group or on an especially large scale, imposing a sentence of 2 years and 10 months in prison with deprivation of the right to engage in activities related to the implementation of organizational, administrative and administrative economic functions in the provision of services related to the repair, construction and reconstruction of buildings and structures for a period of 1 year 6 months, with a term of imprisonment in a general regime correctional colony.
Sergey Golovinsky was found guilty of committing fraud committed by an organized group or on an especially large scale, imposing a sentence of 3 years 2 months in prison with deprivation of the right to engage in activities related to the implementation of organizational, administrative and administrative functions in organizations of any form of ownership in the provision of services related to the repair, construction and reconstruction of buildings and structures for a period of 1 year 6 months, with a term of imprisonment in a general regime correctional colony. It is noteworthy that the prosecutor’s office of the Omsk region requested terms much more serious for each defendant - 9 years in prison.
Civil claim for the recovery of damage caused to the enterprise JSC “GKNPTs them. M.V. Khrunichev” in the amount of 17,858,747 rubles. 70 kop. the court satisfied - part of the debt was repaid by the defendants. In order to ensure the execution of the sentence in terms of the civil claim, the arrest of a one-room apartment in an unfinished building and a land plot of 634 sq. m in Novosibirsk, owned by Golovinsky.
Interestingly, the convicts were not immediately deprived of their liberty. I had to wait for some time for the employees of a separate guard and escort battalion, who took the sentenced into custody.
The verdict has not yet entered into force.
Currently, Golovinsky works as a plant director at Pik-Industriya JSC in the Moscow Region, his brother Dolgushin is the head of the construction organization service at Metro Mir MP in Novosibirsk.
The Polet software was created on July 24, 1941 on the basis of the Moscow evacuated aircraft factories and Omsk enterprises. During the years of the Great Patriotic War, 80 Tu-2 bombers, more than 3.5 thousand Yak-9 fighters were manufactured at the Omsk “Polet”. In 1958, the plant was chosen by the state commission as a site for the production of ballistic missiles. At the end of 2007, Polet became part of the Federal State Unitary Enterprise GKNPTs im. M.V. Khrunichev” as a branch. According to the website of the software, at present the main activities of the enterprise are participation in the implementation of the national space project for the production of the Angara family of launch vehicles, the manufacture of the Breeze-KM upper stage, the completion of the transport and launch extension of the Rokot launch vehicles, production of assembly units for launch vehicles “Proton-M”.
