In Astana, the court sentenced the ex-wife of the nephew Nursultan Nazarbayev Gulmira Satybaldy. She was found guilty of arbitrariness and kidnapping. Judge Kemenger Imashev sentenced Satybaldy to seven years in prison.
According to the court decision, for arbitrariness under article 389 of the Criminal Code of the Republic of Kazakhstan, Gulmira Satybaldy was sentenced to six years in prison, for complicity in a criminal offense and kidnapping – seven years in prison. On the basis of part 3 of Article 58 of the Criminal Code of the Republic of Kazakhstan, a more severe punishment absorbs a less severe one.
“Finally appoint Satybaldy a sentence of 7 years in prison,” Imashev said.
The court also ruled to deprive Satybaldy of the state award – the Kurmet Order.
Two other defendants in the case, Madi Batyrshaev and Rashid Utebekov, were sentenced to seven and five years in prison, respectively.
On the eve of the verdict, the eldest daughter of Gulmira and Kairat Satybaldy applied to the judge and the President of Kazakhstan Kassym-Jomart Tokayev with a request to release their mother. Gulmira Satybaldy herself expressed the opinion that her case is the result of a political struggle between the old and new authorities, and she is a victim of the regime.
Earlier, prosecutor Azamat Sarsembaev announced that Gulmira Satybaldy was charged under three articles of the Criminal Code at once: under article 389 part 3 of the Criminal Code (arbitrariness), under article 125 part 2, paragraph 1, 8 of the Criminal Code (kidnapping), as well as under part 3 article 28 of the Criminal Code (organization of a criminal offense) and asked to appoint she has eight years in prison.
Recall that the criminal case against Gulmira Satybaldy was opened after the statement of the founder of Galanz Bottlers, Tursen Alaguzov. He went to court and stated that Satybaldy illegally took possession of his company. He demanded to recover 6.9 billion tenge from it by returning 43.25% of the shares of GALANZ bottlers JSC, as well as 5 billion tenge for moral damage.
Satybaldy is also accused of arbitrariness and kidnapping of ex-colleague Aigul Mekesheva. At the trial on April 21, Gulmira Satybaldy stated that she partially admits her guilt in terms of arbitrariness. The defendant pleaded not guilty under the other two counts. During the last speech, Satybaldy stated that she managed to reach a mediation agreement with Aigul Mekesheva by transferring part of the company’s shares to her.
Two other defendants in the case, Madi Batyrshaeva (founder and director of Maxi Bottlers LLP), who is accused of arbitrariness and kidnapping, and Rashid Utebekov (Satybalda’s driver), who is accused of kidnapping, Gulmira Satybaldy asked to be found not guilty, since Aigul Mekesheva completely forgave.
