The procedure for holding competitions for ceramic workers of state enterprises is regulated by the Resolution of the Cabinet of Ministers No. 777 dated 09/03/2008. “About the competitive selection of key subjects of the government sector of the economy,” informs Reviewer.
In Article 13 of the resolution it is stated: “The obligatory mind of conducting a competitive selection is its openness. Representatives of the mass media have the right to be present at the meetings of the commission during the opening of the packages of documents submitted by the applicants, in their opinion there is overwhelming interference.”
However, in early 2015, with the submission of the Ministry of Economic Development and Trade before the ruling, changes were made that made the competitions completely closed, added to the contestants any rights and made it impossible to discredit competitions in court.
One of the innovations sounds like this:
“The commission will hear at a CLOSED meeting the competitive proposal of the participant in the competitive selection… . The decisions of the commission at its meetings during the hearing of the competition proposals of the participants MAY BE attended by representatives of the mass media and the community FOR THE MIND OF ALL participants of the competition in I will select.”
If one of the candidates fails (it may be a special “technical” candidate), then the vast majority of people will not get to the committee meeting.
Another cutting-edge innovation was the emergence of a commission under the Committee of Recognition. This order has been “closed” – it has not been publicized until now. At the time of the conversation, the participants in the competition did not know who was asking them questions. It is significant that the document for the competition was not publicized – there was absolutely no publicity on the website of the Ministry of Economic Development and Trade.
The most popular question at the commission’s warehouse is “independent non-state experts.” First of all, the stinks are not independent, so let’s hire them and plant them. “Independent project manager for the sake of reforms” – what do you think? “Nezalezhny General Director of TOV” sounds even more beautiful. On the other hand, it was not possible to know any confirmation of their expert qualifications in the civil sector, not to mention the postal service. No scientific work, no publications, no speeches, no participation in the meetings of the expert community – nothing, no significant unknown people.
Well, the commission was formed in secret, independent experts were not involved there. Once again, miracles begin.
At the closed meeting of the commission, Oleksia Komlichenka, director of Telent Advisors LLC, is gathering its head. Do you see? The head of the GOVERNMENT COMMISSION is the director of the LLC, that is, a representative of the commercial structure!
What does Komlichenko do in his TOV? On the Telent Advisors website it is read: “Among its clients are the largest commercial banks, investment companies and private equity funds.” So, the sovereigns (with the right to the highest vote!) gave the people who earn money from the selection of ceramics that are especially important for the economy of enterprises! In the law “About Corruption” this is called a “conflict of interest”. In Article 35 of this law it is clearly stated that “in the event of a conflict of interests in a person assigned to the official function of the state or a person equal to it, it is necessary to enter into a collegial body (committee, ii, colleges, etc.), she has no right to take part decision made by this authority.”
Before the speech, what did the clients of the independent expert Komlichenko submit documents for this competition that was under his head? What are the competitors of Ukrposhta among your clients? And also, by what means were the competitive proposals stolen – what is the intellectual power of your clients, in other words, applicants for planting pottery plantations of state enterprises?
Another crime is involved: a database of top managers of the region along with their confidential data was released into the hands of a representative of a commercial structure that is involved in personnel selection! And at the same time, the head of the GOVERNMENT COMMISSION, Mr. Komlichenko, did not undergo a special check and did not give a signature about the confidentiality of information!
That’s not all. Immediately after his appointment as the head of the commission, Mr. Komlichenko also, at a closed meeting, RECOGNIZED Yulia Danchik as the secretary of the commission, who is working as the head specialist in the legal department of the Ministry of Economic Development and Trade. Think about it – the director of TOV is a government official!
And government official Yulia Danchik makes a point of attending committee meetings all day long, rather than at work, and signing protocols. It’s cool that outsiders immediately appointed government official Yu. Danchik as secretary of the commission for the production of ceramics of the Elektrovazhmash plant, NEC Ukrenergo, PJSC Centerergo, and DP Ukrspirt. On the right, in the fall of 2015, the Ministry of Infrastructure issued an order to transform the state postal enterprise “Ukrposhta” into a public joint-stock company and created a commission for the re-creation. Now, at the hour of corporatization, the head of the commission is formally in charge of the enterprise, while operational management may be subject to the final responsibility of the general director.
Did they know at the Ministry of Economic Development, when they announced the competition, that there were no such plantings anymore, because there was a change in the type of power in the enterprise? If not, then we will accept the one who signed the order to hold the competition and then proceed to the exhibition. So, it is now urgent for law enforcement agencies to take care of the circumstances surrounding the decision to close down the holding of competitions for planting pottery plants of state enterprises, which led to the creation of numerous corruption risks.
