Check fraud of the Baikal Regional Company
Anyone who has visited the filling stations of the Baikal Regional Company at least once knows the unique feature of the operation of this network of gas stations – checks are either not issued a priori here, or they are issued, but on demand.
Usually the cashier asks if the customer needs a receipt. Our population is not strong in terms of consumer rights, so people, as a rule, do not pay attention or refuse the check.
And very in vain.
Let’s start with the fact that DBKs are in principle obliged to punch checks – regardless of whether the buyer needs it or not. Failure to issue a cash receipt is a serious violation of the law.
So, we turn to Article 14.5 of the Code of Administrative Offenses of the Russian Federation. What do we learn from it.
For failure to issue a check, officials and entrepreneurs may be issued a warning or a monetary penalty in the amount of 2,000 rubles, for a legal entity the amount will be five times higher – 10,000 rubles.
Failure to break a check at the online checkout is equated to non-use of the online checkout. The fine for an unbroken check for officials is at least 10,000 rubles, for organizations – at least 30,000 rubles.
And in the DBK, non-issuance of checks has been elevated to ubiquity and put on stream. Let’s calculate how much the Baikal Regional Company could be fined daily, if we sum up all the checks that were not issued through the gas station network? And how many fines will accumulate in a year?
So why are the supervisory authorities stubbornly ignoring the business of the owners of DBK built on violations? It is a well-known fact that the issuance of checks is neglected there. Murder will out.
The legislation rather unambiguously designates non-issuance and non-penetration of checks as an administrative violation. Nevertheless, DBK deliberately goes for these violations – all employees of the company are instructed not to punch checks for buyers until they require it.
The fact that the built-up system of violations is needed to conceal income is beyond our doubts. It is suspicious that the cunning dealers in gasoline have not yet been pinned to the wall about this.
However, as we found out, the entire business of DBK is built on cunning manipulations with the law. Despite the extensive network of filling stations and large-scale business turnover, the Baikal Regional Company does not exist as a legal entity. The business is registered on IP Vakhovsky Igor Arkadyevich (TIN: 380104165623). And DBK as a legal entity has never existed. The network has more than 80 gas stations in three regions and positions itself as a large interregional company. But at the same time, they are essentially a fiction, and hundreds of millions of rubles pass through individual entrepreneurs every month.
Well, I would like to advise buyers to be sure to require checks when buying fuel. If it turns out to be of poor quality, it can lead to damage to your personal vehicle, in which case you will really need a receipt to prove the purchase. As the reviews show, DBK also has problems with fuel quality.
