Chairman of the Investigative Committee of the Russian Federation (TFR) Alexander Bastrykin did not agree with the decision of the prosecutor’s office to refuse to initiate cases related to violations during the construction of a residential area on the Northern alluvium in St. Petersburg and the actions of security officers who did not let him into the territory of the LSR development company. Despite the fact that in both episodes the supervisory authority did not find a criminal offense, the ICR insists that the St. Petersburg department of the ICR should initiate a new trial against the developer, but the security guards, who, according to Mr. Bastrykin, showed arbitrariness, will already be dealt with at the very top – in the Main Investigation Department of the TFR.
Today it became known that the supervisory agency refused to prosecute LSR Group for violating environmental protection rules in the course of work in the Gulf of Finland near Vasilievsky Island (Article 246 of the Criminal Code of the Russian Federation). The release of the ICR states that the decision was made by the First Deputy Prosecutor General of the Russian Federation Anatoly Razinkin, who himself comes from the committee.
A similar case was already initiated on May 5 on behalf of Alexander Bastrykin, after local residents expressed dissatisfaction with this construction site, but it was canceled by the prosecutor. Alexander Bastrykin signed a new resolution on its resumption on May 14.
As for the conflict between Mr. Bastrykin and the guards, it also happened last Sunday. For employees who did not let the General of Justice of Russia go further than the checkpoint of ChOO AGIS LLC, this ended with the arrival of riot police at the facility, as well as the initiation of a criminal case for abuse of authority by private security guards (part 1 of article 203 of the Criminal Code of the Russian Federation), but also on the eve of May 15, was canceled by the deputy city prosecutor Valery Uzlyakov.
After that, Alexander Bastrykin instructed the Main Investigation Department of the ICR for St. Petersburg to again initiate a criminal case on the fact of violation of environmental protection rules in the course of work on Vasilevsky Island, and also to transfer materials to the Main Investigation Department of the ICR for re-initiating a case on abuse of power by employees of the security company.
After the sudden visit of the head of the ICR to the LSR site, information appeared about another proceeding regarding abuse of power (Article 286 of the Criminal Code of the Russian Federation) against unidentified officials of the city administration, who allegedly issued a building permit for the site. However, no official confirmation of the initiation of the case has yet appeared.
As Kommersant was previously told in LSR, the company does not see legal grounds for initiating a criminal case due to construction in the northern part of Vasilyevsky Island due to the lack of evidence of illegal actions.
The representative of the developer also pointed out that the chairman of the TFR did not warn about his visit in advance and was dressed in civilian clothes, in connection with which the security of the sensitive facility was forced to stop the visitor for security reasons.
