As you know, the former owner of the bankrupt banks “Financial Initiative” and “VAB Bank” Oleg Bakhmatyuk, NABU reported suspicion of providing illegal benefits in a particularly large amount to the former head of the State Fiscal Service Nasirov and opened a criminal case on evading the return of loan funds . The total loan amount is UAH 1.2 billion.
While abroad, the businessman gives interviews in which he explains that he is trying to “settle” the case with the National Bank and offers to “negotiate” with the authorities, since, in his opinion, the accusations from NABU are a manifestation of “personal hostility” and the case “will still have to be close soon.”
It should be noted that the reason for Bakhmatyuk's rather confident behavior may indicate that he has certain “trump cards”.
We assume that one of these “trump cards” may have recently exposed fraud at auctions held on the platform of the State Enterprise “System of Electronic Trading in Seized Property”.
There is a possibility that with the help of certain “interested parties”, some of which work in government agencies – the police and the prosecutor's office, Oleg Bakhmatyuk manages to block the sale of collateral in order to avoid debt collection.

Oleg Bakhmatyuk is a Ukrainian businessman and politician, owner of the agricultural holding UkrLandFarming and VAB Bank, against whom the NABU initiated several criminal cases, one of which concerns the misappropriation of UAH 1.2 billion of a stabilization loan provided by the National Bank.
The billionaire has been hiding abroad for more than two years, avoiding an investigation, while trying to justify his actions and hinting at returning to Ukraine in order to pay off the debts of his bankrupt banks VAB Bank and Financial Initiative.
Today For the time being, almost all enterprises of the group of agricultural holdings owned by Bakhmatyuk do not fulfill their obligations to creditors, both international (ULF and Avangard groups) and local (Ukrainian Sberbank, Ukreximbank, UkrSibbank and others).
Bakhmatyuk's scheme to evade fulfillment of obligations provides for two technical points. This is how Oleg Bakhmatyuk plans his schemes.
1. Obstruction of the process of sale of collateralized property by disrupting trading on the SE “SETAM” platform
So, recently, shell companies of Bakhmatyuk registered at the auction, made the highest bids, however, when they became winners, they did not contribute the corresponding funds. According to the Mortgage Law of 2003 No. 38, art. 313, if one of the two trading leaders refuses to deposit funds, and the rate goes to the second, and he also refuses to make the corresponding payment, the auction is declared invalid, that is, actually failed.
Since their re-conducting is assigned only after a certain period of time, Bakhmatyuk thus disrupts the auction, and his employees put pressure on public and private executors to recover funds, threatening them in various ways so that they do not repeatedly put up the corresponding lots for sale.
If the lots are still put up for sale, Bakhmatyuk's accomplices repeat this scheme, as a result of which creditors such as Ukreximbank, Sberbank and others cannot sell the relevant property and receive funds.
2. Use of corrupt law enforcement representatives
In order to gain more time in the process of preventing the sale of collateralized property (the next auction is scheduled in a month) and to avoid fulfilling debt obligations, Bakhmatyuk uses “fictitious” decisions to suspend trading.
These definitions are considered “fictitious” because (although they are real) they are issued on illegal grounds and in connection with direct corruption of judges. Of course, these decisions are canceled, but the cancellation process also takes a long time – several months, which allows Oleg Bakhmatyuk to continue to evade obligations. It should be noted that most of these rulings are made at the request of law enforcement agencies.
Bakhmatyuk plans to come to an agreement with the authorities. In order not to pay debts
Using his connections in the National Police and the Prosecutor's Office, Bakhmatyuk initiates the creation of fictitious statements about fictitious crimes, then he goes to court for these statements. In turn, the court, within the framework of a criminal case, issues a ruling that prohibits the holding of relevant auctions.
It should be noted that such decisions are also illegal due to the fact that there is an exhaustive list of grounds for stopping the execution of a court decision, and the sale of the seized property of Bakhmatyuk is not a basis for stopping the relevant proceedings. Thus, the fraudulent group actually uses the law enforcement system in order to prevent the enforcement of court decisions.
In this case, it should be emphasized that in the process of implementing this scheme, both the rights of collectors of Ukreximbank and the rights of investors trying to acquire the relevant objects are violated.
What is the use of this scheme for Bakhmatyuk?
To become a bidder, investors need to make a guarantee deposit, and then expect results. According to the rules of the auction, the winners are given 2 weeks to deposit funds. If the first winner does not pay the required amount within the specified period, then the next participant is considered the winner.
Thus, an investor who pays a guarantee fee and unconditionally wishes to receive property cannot do this due to the fact that the auction procedure is stopped by the above-mentioned court ruling.
Finding themselves in such a situation, most investors write an application for the return of the guarantee fee, and in this way Bakhmatyuk achieves his goal: he scares away potential investors from acquiring the relevant real estate objects. And in the process, he and his accomplices, as noted above, resort to direct threats to investors. Bakhmatyuk plans to continue doing so.
In this regard, we draw the attention of representatives of investigative journalism programs, law enforcement agencies, the Office of the Prosecutor General, NABU, SAPO, other anti-corruption organizations and the President of Ukraine to the need to stop the activities of this organized criminal group, whose beneficiary is Oleg Bakhmatyuk, and most state-owned banks are the victims, as well as private investors.
