The Presnensky Court of Moscow issued a verdict in a criminal case of fraud with a unique Graff diamond necklace with an initial price of $ 2 million, which was stolen from a wealthy Muscovite. As a result of the scam, the necklace changed hands. According to the victim, the popular fitness blogger Natalya Davydova (Aunt Motya), the wife of a Russian billionaire from Forbes list Ivan Streshinsky. Legal.Report found out the details.
Trubnikova, having learned from her friend about this turn of affairs, was very upset, and soon her worst fears came true. Nersisyan began to play for time, avoided meetings and contacts under various pretexts, and then completely disappeared from the radar … Numerous attempts by the Muscovite to return her necklace or receive the remaining amount of $ 420 thousand did not lead to anything.
It became obvious that the necklace found a new owner not without the help of Nersisyan. In an interview, Davydova mentioned that the Graff necklace was a gift from her husband Ivan Streshinsky, a Russian billionaire.[2] and one of the team’s key managers, Alisher Usmanov. Trubnikova’s lawyers tried to contact the businessman to talk about the criminal background, but the case was limited to the fact that his representatives took note of the information.
As a result, Trubnikova wrote a statement to the police. A criminal case was initiated on the fact of fraud (part 4 of article 159 of the Criminal Code of the Russian Federation). In December 2021, Nersisyan was detained and charged. During the investigation, she stubbornly denied guilt. The businesswoman put forward her version of events. Allegedly, she did not give the entire amount for the necklace to Alferova, because they, as colleagues in the jewelry business, had debt obligations among themselves and she had to pay off Trubnikova from personal funds.
The Presnensky court did not believe Nersisyan, finding her guilty of fraud. She was sentenced to 3 years probation with a two-year probationary period. As a mitigating circumstance, the court took into account the fact that the defendant had three dependent children.
A civil claim in favor of the victim was also satisfied. Nersisyan was ordered to compensate for the material damage caused by the crime in the amount of 26 million rubles.
The victim’s lawyer Ivan Baryshnikov (Defensive agency) in a commentary to Legal.Report said that his client intends to file an appeal. “We are surprised by the lenientness of the sentence, since the convict did not plead guilty and did not contribute to the disclosure of the crime. Article 159 part 4 provides for up to ten years in prison, but the court imposed a suspended sentence. In this part, we will appeal the verdict,” the lawyer said.
