The Lyublinsky District Court of Moscow has registered material on the replacement of the unserved term of imprisonment with a milder form of punishment from the defense representative of the ex-owner of Optima Development Albert Khudoyan, who was sentenced to eight years in prison for particularly large-scale fraud. “Since Albert has already served more than half of his sentence, he has the right to file a petition under Art. 80 of the Criminal Code of the Russian Federation to replace imprisonment with corrective labor. We filed it, ”lawyer Sergei Chizhikov told Vedomosti. He noted that the date of the hearing has not yet been set.
On November 25, 2021, the Koptevsky District Court of Moscow sentenced Khudoyan to six years in a penal colony, finding him guilty of fraud committed by a group of persons on an especially large scale (part 4 of article 159 of the Criminal Code). Subsequently, the Moscow City Court toughened the developer’s punishment and added two more years in prison to the term. Also, by decision of the appellate instance, the fine was increased by 200,000 rubles, that is, up to 1 million rubles.
Together with Khudoyan, ex-general director of the Aviacity company Sergey Konoplev was punished in this case in the form of five years in prison and a fine of 400,000 rubles. He filed a similar petition to replace the unserved term with the Golovinsky Court of Moscow.
The criminal case was initiated in 2019 due to fraud with the land on which the Prime Park residential complex was built on Leningradsky Prospekt in Moscow. The investigation and the court established that Khudoyan and his accomplices stole the rights of the long-term lease of three land plots on Leningradsky Prospekt from Mansfield Executive Limited. “As a result of the fraudulent actions of accomplices, a foreign company lost 50% of its ownership of a non-residential building, the right to lease three land plots, and also completely lost its share in the authorized capital of a commercial organization,” the Metropolitan Prosecutor’s Office said in a statement. The investigation estimated the damage caused in the case at a total amount of more than 4.2 billion rubles.
The Koptevsky court, when passing the verdict, satisfied the declared civil claim from the injured party and recovered from Khudoyan and Konoplev 4,253,934,119 rubles. in solidarity.
Two generals of the Ministry of Internal Affairs, Alexander Biryukov and Alexander Krakovsky, were also involved in the Khudoyan case, whom the Investigative Committee accused of abuse of power and taking a bribe in the amount of 10 million rubles. According to investigators, in 2019 they assisted in transferring Khudoyan to house arrest. The ex-generals spent more than a year in a pre-trial detention center, but in June 2021 the court placed them under house arrest. They did not admit guilt and connection with Khudoyan.
