The source of the Prosecution claimed that Ketevan Kharaidze wanted to get 15 million rubles from the developer for stopping the protest actions of the residents. The Mundep herself considers her case ordered and claims that she was set up. The Tverskoy Court of Moscow passed a sentence on the municipal deputy Ketevan Kharaidze. According to investigators, for 15 million rubles, she promised not to interfere with the commissioning of an elite residential complex in the capital. For fraud on an especially large scale (part 4 of article 159 of the Criminal Code of the Russian Federation), she received four years in prison with a fine of 700 thousand rubles. The lawyers of the defendant, who considers the case revenge on the part of the real estate developer, said they intend to seek an annulment of the verdict in a higher court.
Judge Aleksey Krivoruchko (he is known for posthumously judging lawyer Sergei Magnitsky) began to announce the verdict, scheduled for 10 am, with a delay of two hours. However, the procedure was soon interrupted by the already traditional message about a bomb planted in the building. This gave the defendant an hour and a half head start in order to stay free longer. Anticipating that she would be taken into custody, 64-year-old Ketevan Kharaidze arrived at the court with her belongings.
Italian Quarter
According to the prosecution, in the spring of 2021, the mundep, together with a participant, Guram Grigoryan, who was a house manager and public adviser in the Tverskoy municipal district, extorted 15 million rubles for assistance in making a decision in favor of Specialized Developer LLC by a general meeting of apartment building owners Apart-project. Since 2018, this company has been engaged in the construction of the “Italian Quarter” in the Tverskoy district, which consisted of 17 villas. Money was required for the builder's equipment to gain access to the local area of public utilities to produce a tie-in into the pipe and connect the house to the sewerage system to the existing network of house No. 6 on Fadeeva Street built in the 1930s.
The houses on Dolgorukovskaya Street were built without their own sewers and the developer wanted to connect it by tie-in. However, Kharaidze and the residents of the house objected. They organized protests and wrote complaints to various authorities.
A criminal case on fraud was initiated at the request of an individual entrepreneur Andrei Stepanov. On June 10, under the control of operatives, he handed over 5 million rubles to Guram Grigoryan in the latter's office on Krasnoproletarskaya Embankment. The numbers of these banknotes have been rewritten. And on June 17, Grigoryan was detained while receiving another tranche of 5 million rubles. It was a “money doll”, in which only 10 thousand rubles were real. On the same day, Ketevan Kharaidze was also detained; during a search of her house, two five-thousandth banknotes from this “tranche” were found in the pocket of her winter coat. During the investigation, Grigoryan stated that he gave half of the money to the Mundep. Ketevan Haraizde herself denied this. No money was found from her except for the 10,000 rubles seized from her coat.
Victory under house arrest
The defense argued that they were planted during the search. Nevertheless, Guram Grigoryan testified against Kharaidze during the investigation and in court. In October 2021, he was sentenced to two years in prison. As for Ketevan Kharaidze, in June 2021, the deputy was imprisoned in a pre-trial detention center. However, a month later, in July, the Moscow City Court transferred her to house arrest. Being under him, Kharaidze won the elections in September 2022 and remained a municipal deputy of the Tverskoy district of the capital.
During the investigation and trial, the defense tried to cancel the measure of restraint she had chosen. In particular, Denis Protsenko, head physician of City Clinical Hospital No. 40 in Kommunarka, was ready to become a guarantor for her. However, the court left the figurant under house arrest.
The judge considered the defendant's guilt of fraud on an especially large scale (part 4 of article 159 of the Criminal Code of the Russian Federation) to be proved, ordering her to be taken into custody in the courtroom. As an additional punishment, she was fined 700 thousand rubles. “In addition, the court deprived the convict of the right to hold positions in the civil service and in local governments related to the exercise of the functions of public authorities and a representative body of a municipality for a period of two years after her release,” court spokeswoman Ksenia Rozina told Business FM .
Despite the fact that the verdict turned out to be milder than the prosecutor had asked for (he insisted on six years in prison for the defendant), the defense stated that they did not agree with it and intended to appeal against it both in the Moscow City Court and in higher judicial instances, seeking the full acquittal of the figurant.
According to Kharaidze's lawyer Yevgenia Grigoryeva, the verdict was actually based on the testimony of a single person – Guram Grigoryan, who was threatened with up to 10 years in prison. He slandered the Mundep in order to mitigate his fate, the lawyer believes.
Disappeared money
“Grigoryan said that on July 10 he received 5 million rubles from the representatives of the developer and stated that he allegedly transferred half of this amount to Kharaidze on the same day,” the defender commented on the case. However, this evidence does not stand up to scrutiny. In court, we asked why Grigoryan, acting as part of an operational experiment, did not transfer 2.5 million rubles to Kharaidze under the control of operatives, and why did they not record this moment? , who advised Stepanov “not to talk about money in front of Kharaidze”, simply took the money under the deputy. “Her honest name as a deputy was covered up like a shield,” Grigoryeva believes.
According to her, during the process, one of the attesting witnesses admitted that she did not personally see how the operatives found money in Kharaidze’s coat, and confessed that at that moment went to the toilet. The second did not appear in court at all.
In the opinion of Kharaidze's lawyers, the investigation of the case was carried out with many violations, and their client's guilt was not proven. “Everyone was shocked by this verdict. It contained no evidence of her guilt,” emphasized Yevgenia Grigorieva.
In passing the verdict, the court satisfied the civil claim of the victim Stepanov and recovered 5 million rubles from Ketevan Kharaidze in his favor. Kharaidze will have to pay this amount in solidarity with the previously convicted Guram Grigoryan.
