The company has been bankrupt for several years, its property is being sold.
The bankruptcy trustee Alexander Baskakov of the Balakovo CJSC INESS is trying to bring four of its former leaders to subsidiary liability. The bankruptcy card refers to Evgeny Kochkurov (November 2019 – March 2020), who replaced him Mikhail Kotyakov (until September 2020), as well as Natalya Tokareva (until January 2022) and Sergey Tokarev (five days in January 2022).
The manager filed an application on June 10, his motivation, as well as the amount of subsidiary liability, are not yet known – the document has not yet appeared in the arbitration filing cabinet.
The CJSC has been going bankrupt since December 2020 at the suit of the Interdistrict Federal Tax Service of Russia No. 2 for the Saratov Region. A major contractor of the Balakovo NPP, affiliated with the family of the ex-governor Pavel Ipatov, owed the tax authorities 20.2 million rubles.
The relationship between the tax and bankruptcy trustee, Mr. Baskakov, is striking in its diversity. So, he butted heads with the department because of the payment of salaries to INESS employees. The department considered that he violated the procedure for repaying debts to creditors and challenged his actions on appeal, the cassation supported her.
The arbitration, meanwhile, satisfied the application of the ex-director of ZAO Viktor Kolzhanov and included him in the register of creditors with an amount of more than 89 million rubles. He lent the money to the company. Mr. Baskakov, together with the tax authorities, tried to challenge the appearance of such a large creditor, appealing to the fact that Kolzhanov did not have such money. But to no avail: the appeal overpowered the decision of the first instance.
The bankruptcy trustee, with varying success, is trying to challenge transactions for the sale of INESS property. We are mainly talking about vehicles: in February, the arbitration from 6 trucks and cars returned two to the bankruptcy estate. In March, two cars were sold at auction.
At the same time, the cost of 19 devices included in the bankruptcy estate became known – 2.8 million rubles. Of these, 14 pieces of equipment were put up for auction, buyers were found in May for only 5 devices.
In April, the arbitration refused Baskakov to invalidate the contract for the replacement of a party to an obligation, an agreement on compensation and the return to the bankruptcy estate of an arched warehouse building (1.3 thousand square meters) located on the territory of the BNPP, as well as the right to lease a land plot there (15 .5 thousand square meters).
The documents were signed in October 2019, the new owner is Electroengineering LLC. Its founder and director since 2018 is Denis Kolzhanov. Judging by the patronymic – the son of the already mentioned Viktor Kolzhanov. The latter was also listed among the founders of this LLC, then transferring his share to his son. Kolzhanov Sr. at the same time was among the founders and leaders of CJSC INESS.
Baskakov appealed to the affiliation of the companies to each other, the nominal nature of the transaction and the fact that it was not approved by the board of directors of the company. However, the court considered the relationship between the companies to be real and denied the manager’s request.
A similar fate befell an attempt to invalidate the contract of sale to the same “Electroengineering” of the oil station for the TR-2-80 pipe destroyer, the TR-2-80 pipe destroyer. It was not possible to return to the bankruptcy estate the next four vehicles of the enterprise.
It is curious that the fate of two real estate lots put up for auction in January of this year cannot be traced from the bankruptcy card. It was a non-residential building (1,000 square meters) with gates and air conditioning, the starting price was 18 million rubles (previously 20 million rubles).
As well as lot No. 2 – two non-residential buildings (total area of about 3.7 thousand square meters), an open area with crane runways (3.7 thousand square meters) and the electric gantry crane itself. The initial price of the lot is also 18 million rubles (previously – 20 million rubles). There are no reports of the property being bought or withdrawn from the auction.
In mid-May, tenders for the next seven lots with equipment were announced. Prices fluctuate between 200-400 thousand rubles, the auction step is 5%. Applications are accepted until June 26th.
At the end of June, the arbitration will also consider the petition of Baskakov, who is disputing the sale of three trucks to the Saratov Electric Networks LLC. The committee of creditors is scheduled for June 16. There are two items on the agenda: the report of the bankruptcy trustee and the approval of additions and amendments to the regulation on the procedure and terms for the sale of the identified property of the CJSC.
Recall that the activities of CJSC INESS were repeatedly associated with the ex-governor of the Saratov region Pavel Ipatov, who, as you know, began his career as an engineer at the Balakovo NPP and rose to its director, and then the deputy general director of Rosenergoatom. Affiliation is also confirmed in documents.
So, according to Kartoteka.ru, in 2017 the daughter of the governor, Ipatova Anna Pavlovna, was a member of the board of directors of Russian Energy Company OJSC (ERKO). The ERKO quarterly report for 2017 indicates that Anna Ipatova was the head of INESS CJSC from 2007 to 2012, that is, in fact, even when Pavel Ipatov was the Saratov governor. At the same time, Ms. Ipatova is not included in the list of all directors of the CJSC who have replaced each other for several years. The ERKO company itself, in which INESS once owned 9%, is now going bankrupt and in the spring of 2020 reached bankruptcy proceedings.
At the same time, INESS was known as a permanent executor of construction orders for the Balakovo NPP. So, in 2015, the company built a training camp for the protection of a nuclear power plant, estimating its services at 244 million rubles. And she conducted work on engineering and geological surveys at the construction site of the guest buildings of the boarding house for Balakovo nuclear scientists.
CJSC INESS was registered in this form of ownership in August 1998. This is a well-known Balakovo construction company that appeared after the reorganization of the Balakovo commissioning site of the Gidroelekromontazh trust. CJSC was engaged in industrial construction, including nuclear power facilities, building design, manufacturing, diagnostics, installation and repair of electrical equipment, manufacturing of metal structures and reinforced concrete products. The company is based on the site of the Balakovo NPP, once its regular customer.
