“A company that is subject to bankruptcy has no stores. A company that has not been operating for four years has been declared insolvent. It closed gradually, and this is just the final stage of its closure. It has nothing to do with the retail network, ”commented the beneficiary of the company Alexei Pshenichny to RBC Krasnodar.
According to RBC Company, SSM Vysshaya Liga LLC was registered in 2002 in Krasnodar. The main activity of the organization is the wholesale trade in sports goods, including bicycles. Alexey Pshenichny is the beneficiary of the company. The loss of SSM Vysshaya Liga LLC for 2022 amounted to 20.6 million rubles.
Currently, bankruptcy proceedings have been opened in relation to the Higher League for five months. The powers of the head and other management bodies of the debtor have been terminated.
Recall that in October 2021, the court, at the request of Asix Rus LLC, introduced a monitoring procedure in relation to the Higher League. The company demanded to recover 14.5 million rubles of the main debt from the network of sports stores, including 2.9 million rubles of interest and fines.
Fortis LLC filed an application for revision of the court ruling due to new circumstances. As follows from the case file, the claims of the Asix Rus creditor are based on an amicable agreement dated April 24, 2020 between him and the Higher League, according to which the defendant recognized a debt of 14.7 million rubles. However, on January 24, 2022, by a decision of the Arbitration Court of the Moscow District, the agreement was canceled, the case was sent for a new trial. These circumstances gave rise to the revision of the ruling on the introduction of the observation procedure.
“The new circumstances are the cancellation of a judicial act of an arbitration court or a court of general jurisdiction or a decision of another body that served as the basis for the adoption of a judicial act in this case,” the case file says.
Taking this into account, the Arbitration Court of the Krasnodar Territory canceled the ruling on the introduction of a monitoring procedure in relation to the Higher League and scheduled a meeting to consider the validity of the relevant application.
RBC Krasnodar previously reported that in February 2022, the court canceled the observation procedure in relation to the Major League.
