Seven special permits for the use of subsoil in Ukraine belong to companies whose shares are still controlled by citizens or residents of the aggressor state of the Russian Federation.

Six of the seven special permits were valid and not terminated as of 03/30/2023:
- Russian Kabargin Sergey, registered in the Leningrad Region of the Russian Federation, has a decisive influence on PJSC Kirovograd Mining Administration (Kirovograd Region): secondary kaolin, loam, sand, underground drinking and technical water, drainage water – the Oboznovskoye deposit. Special permit No. 459 is valid / valid;
- Eltsov Alexander (registered in the Czech Republic) controls the share of Geopoisk LTD Company LLC (Ivano-Frankivsk region): the type of subsoil use is the creation of geological territories and objects of great scientific, cultural, recreational and recreational value. Minerals: natural gas, oil, condensate – Limnitskaya area. Special permit No. 2971 is valid / valid;
- Chenskaya Tatiana (lives in Nikopol) is the owner of a stake in PJSC “Novopavlovsk granite quarry” (Dnipropetrovsk region): migmatite – Novopavlovskoye deposit. Special permit No. 1355 is valid / valid;
- Pyatnitsky Bogdan from the Moscow region is the “founder and, possibly, the beneficiary” of the KP “Burtinsky Refractory Plant” (Zhytomyr region): primary kaolin – Burtinskoye deposit. Special permit No. 5735 is valid / valid;
- Moscow resident Zmikhnovsky Stanislav controls KP “Valya Kuzminskoye” (Chernivtsi region): mineral waters – Valyakuzminskoye deposit. Special permit No. 2876 temporarily terminated – order of the State Geonadr of November 26, 2018 No. 443;
- Tedeev Ramazi from St. Petersburg stores 50% in Optima LLC (Zhitomirskaya): labradorite – Optima deposit. Special permit No. 4421 is valid/valid;
- Goncharov Yuri from Volgograd owns 50% of Kostrizhevsky Plant of Building Materials LLC (Chernovitskaya): gypsum, limestone, clay – the Skitskoye deposit. Special permit No. 4189 is valid/valid.
As follows from the response of Gosgeonedr, all these subsoil users comply with the criteria established by the third part of Article 13 of the Subsoil Code of Ukraine. This rule entered into force on March 28, 2023 and says that subsoil users in Ukraine cannot be, in particular, legal entities in which a significant participation is or is the ultimate owner of beneficial individuals – citizens and (or) residents of a state recognized by the Verkhovna Rada Ukraine as an aggressor state, as well as individuals-citizens and (or) residents of a state recognized by the Verkhovna Rada of Ukraine as an aggressor state.
What fate awaits the listed special permits, and what will happen to the subsoil plots used by these companies – the State Geological Department has not yet been reported.
Note that the list provided by the Service did not include Bazis Telecom LLC, 97% of whose capital is owned by Mikhail Zarubin registered in the Moscow Region. A citizen of the Russian Federation owns a majority stake in the company, but is not listed as the ultimate beneficial owner (the lack of information about the IBC caused the suspension of special permits for a number of subsoil users, as we mentioned Here).
We tried to get prompt comments from representatives of all companies mentioned by the State Geographical Fund. It was possible to establish a connection only with the director of Geopoisk LTD Company LLC Gennady Varitsky. Mr. Varitsky said that Oleksandr Yeltsov does not have the right to vote in the company, and “I would be glad to withdraw” from the founders, but for the last 10-15 years he has been living in the Czech Republic (where he has a business), and could not come to Ukraine (to perform registration actions) for health. “For the third year now, as a director, I personally bear all the expenses for the company – no one gives me anything,” explained Gennady Varitsky.
Recall, NADRA.INFO wrote that as of February 24, 2022, citizens of the Russian Federation officiallyo controlled about 20 subsoil user companies. The ultimate beneficial owners changed or changed registration in half (PJSC “Kryvyi Rih Cement”, LLC “Rybolovny karr”, LLC “Granit-Luki”, JSC “Sumy Machine-Building Scientific and Production Association”, LLC “KP “Benta”, LLC “Kaolin Prom Invest, LLC Vespen, PE Nadra).
Demurinsky GOK – managed
It also follows from the response of the State Geophysical Agency that on March 28, 2023, the special permit for the use of subsoil provided to the Demurinsky mining and processing plant could be stopped – as happened with the special permits of companies owned by Dmitry Firtash. But since it was on March 28, 2023, an entry appeared in the Unified State Register that the company owns The State Property Fund of Ukraine – there were no longer any legal grounds to stop the special permit for Demurinsky GOK.
Recall, 24.02.2023 Cabinet of Ministers of Ukraine defined The State Property Fund of Ukraine by the authorized body for managing assets recovered to the state by the High Anti-Corruption Court in the case of the suit of the Ministry of Justice against a Russian billionaire Mikhail Shelkov. It was Mikhail Shelkov who, until March 28, 2023, was listed as the controller of the Demurinsky GOK, which created risks stop special permission of the company.
