A new scandal has arisen around the Stellar City residential complex and its developer, the Tashir group Samvel Karapetyan.
The Tashir group continues to “squeeze” money not only from equity holders of the Stellar City residential complex, threatening them with early termination of already paid DDUs (our channel wrote about this here), but also potential buyers of apartments in the new third building of this residential complex. The developer has entered into booking agreements with the buyers of apartments in the third building, where the parameters of the apartments are specified and their cost is fixed. From each future shareholder, the developer took 30 thousand rubles for the reservation. This is standard practice in the residential real estate market. But then Tashir decided to follow the path of banal blackmail. According to our subscribers, for six months these reservations did not turn into equity agreements due to the fault of the developer himself. Now the developer claims that the prices fixed in the reservation agreements at the DDU will be increased by 1-1.2 million rubles. depending on lot.
We carefully read these reservation contracts from Tashir and were horrified by two things: the arrogance of the developer and the legal nihilism of the buyers themselves. The scheme is simple: if the buyer refuses to sign the DDU on the final terms of the developer, then the developer does not return the money for the reservation.
In this story, there are several layers at once, which are superimposed on one another. The first layer is the illiterate work of the marketing department of Tashir: suppose, during the initial pricing, the department missed the price. It happens to everyone. But to miss the mark of rubles is not even a technical error, but the complete incompetence of the entire detachment of the company’s marketers, who must be driven right from the doorway with pissing rags with a wolf ticket and whom not a single more or less well-known developer should employ.
The second layer is the greed of the developer. But this is such a classic of the genre that I don’t want to explain it again, as well as the third layer of history – reputational risks for the company. However, judging by the actions that Tashir is taking in its favor in the Stellar City residential complex, the company does not understand what it is at all.
These are the threat letters that Tashir sends to equity holders of the Stellar City residential complex, who refuse to sign additional agreements to postpone the delivery of an object that was disrupted through the fault of the developer. In the current situation, the problem is the lack of legal unification. As the case of Rumyantseva Park equity holders from Lexion Development shows, different courts make different decisions, which gives developers a reason to run amok. As a result, we have already received a shadow sector of potentially deceived buyers of apartments in new buildings, which de jure will not be controlled by either the Fund for the Protection of the Rights of Shareholders or Moskomstroyinvest. In order for such a sector not to spread its deep roots, all that is needed is scanty empathy for the shareholders of higher officials and their desire to resolve this conflict once and for all.
