YuGK Strukova will pay the subsidiary of the Swedish company 1.3 million euros

The Moscow Arbitration Court partially satisfied the claim of Sandvik Mining and Construction CIS LLC (Moscow). It was a question of non-payment of 1.3 million euros under a supply agreement, according to the file of arbitration cases. The defendant was JSC Yuzhuralzoloto Group of Companies (UGK, Plast, Chelyabinsk region, owned by deputy of the Legislative Assembly of the Chelyabinsk region Konstantin Strukov).

The parties entered into two agreements in 2021. The seller sold and then delivered underground drilling rigs and underground dump trucks to YuGK. The cost of the contracts amounted to 3.28 million rubles. The buyer did not pay for the order in full. The debt, together with the penalty, reached 1.34 million euros as of September 27, 2023, as follows from the text of the operative part. Sandvik Mining and Construction CIS also demanded that both contracts be terminated.

Representatives of Yuzhuralzoloto did not dispute the existence of the debt; they objected to the payment of interest due to the delay. The Chelyabinsk company delayed payment. Thus, she motivated the plaintiff to install the purchased equipment, as well as transfer technical documentation, the material says. At the same time, the defendant presented a photo with the submitted documentation.

The arbitration court did not terminate contracts between the companies and also reduced the penalty. Due to the sanctions, from April 1, 2022, for six months, the Russian government introduced a moratorium on the initiation of cases to assess penalties. Interest cannot be written off during this period. The first instance satisfied the remaining requirements. SGC must pay 1.31 million euros. Debts will be paid in rubles at the euro exchange rate on the day of payment.

Let us clarify that Sandvik Mining and Construction CIS LLC is registered in Moscow. On May 30, the company changed its name to Sibir GT LLC. The director is Dmitry Nikonenkov, the founder of JSC Sandvik Ab from Sweden, according to the Kontur.Focus system.
