The Court of Appeal partially satisfied the complaint of the SAPO prosecutor and chose a measure of restraint for the ex-member of the National Commission on energy issues.
The Appellate Chamber of the Supreme Anti-Corruption Court chose a measure of restraint in the form of a personal obligation to the former member of the National Commission for State Regulation in the Energy and Public Utilities, Victoria Morozova, suspected by NABU and SAPO of official negligence related to the “Rotterdam +” formula.
This decision was made by the AP VAKS on December 19, reports Slovo i Delo.
“The appeal of the SAPO prosecutor is satisfied in part. The decision of the investigating judge of the VAKS dated November 25, 2022 is to be canceled. Decide on a new decision, by which the petition of the NABU detective, approved by the SAPO prosecutor, on the application of a preventive measure in the form of bail (Viktoria Morozova – ed.) is partially satisfied. Apply to (Victoria Morozova – ed.), suspected of committing a criminal offense under Part 2 of Art. 367 of the Criminal Code of Ukraine, a preventive measure in the form of a personal obligation,” the decision says.
She was also assigned the following duties: not to leave the Kyiv region without permission; arrive on demand; report a change in their place of residence and refrain from communicating with suspects in this criminal proceeding, as well as witnesses.
Will Viktoria Morozova go to jail in the Rotterdam+ case?
As a reminder, on October 26, NABU and SAPO reported that 15 persons were suspected of inflicting more than UAH 20 billion in losses from the Rotterdam+ formula for 2018-2019. Among the suspects are two former heads of the NEURC Dmitry Vovka and Oksana Krivenko, former and current members of the National Commission, as well as other persons.
Earlier, NABU completed the investigation of the old episode of the Rotterdam+ formula case. In it, according to investigators, General Director of DTEK Grids Ivan Gelyukh and another manager of DTEK Boris Lisovoy, by prior agreement with the former head of the NEURC Dmitry Vovk, former member of the National Commission Vladimir Evdokimov, deputy head of the energy market department of the NEURC Taras Revenko and the head of the department of this department Vladimir Butovsky long before the adoption of the Rotterdam Plus formula, the possibility of its implementation was discussed. At first, they allegedly planned to apply the formula only to the coal that is delivered to Ukraine by ports. However, the amount of such coal was approximately 130 thousand tons per year out of the total volume of coal of this grade that is used at thermal power plants, which is 25.5 million tons.
Therefore, later all the above-mentioned persons agreed to apply this formula to the entire volume coal, which was proposed by officials of the NEURC at a meeting on January 28, 2016. Already on March 3 of the same year, officials of the National Commission, after obtaining permission from the Antimonopoly Committee of Ukraine, ensured the consideration of the agenda, which included the issue of the Rotterdam Plus formula, which was approved at that meeting. Preliminary examination established an alleged UAH 18.87 billion of damage caused by the implementation of this formula by NEURC, since the DTEK group of companies, which occupied a share in thermal generation of 70% -80%, received super profits from it.
