Prosecutor of the Bolhrad district prosecutor’s office in Odessa Region Vasyl Rusanzhyk has been punished for improper performance of his official duties. The 368.media editorial office learned about this from a decision of the SCCU.
Rusanzhyk previously held the post of first deputy head of the Izmail local prosecutor’s office, and from March 15, 2021 he was transferred to the post of prosecutor in Bolgrad. He was the subject of a complaint by the head of the regional prosecutor’s office, Serhiy Kostenko. Rusanzhyk had two mistakes. In February 2016, he informed the man on suspicion of part 3 of article 185, part 2 of article 190 of the Criminal Code, and already in March the indictment was sent to the Izmail city district court.
Following a preparatory court hearing with Rusanzhyk on 12 May, the court returned the bill of indictment to the prosecutor to correct the identified deficiencies due to its non-compliance with the requirements of p. 2, 5 ч. 2.5 of Article 291 of the CCP. Vasil Rusanzhyk did not send the bill of indictment to the court again and, accordingly, the court did not consider the criminal proceedings.
Rusanzhyk also improperly performed his official duties in the organization of procedural management of the criminal proceedings on suspicion of a man under part 1 of article 309 of the Criminal Code. In particular, after the announcement of the suspicion and approval of the indictment on 15 February 2017, the materials of the criminal proceedings to the Izmail City District Court of Odessa region were not sent by Prosecutor Rusanzhyk.
In the complaint, the author points out that Rusanzhyk V.P. failed to perform his official duties for 7 years while exercising procedural leadership in another criminal proceeding, as the said materials sent by the Rivne local prosecutor’s office to the Izmail inter-district prosecutor’s office in December 2014 were without movement and were physically found by prosecutor Rusanzhyk.
Thus, during this period, no pre-trial investigation was carried out at all in the said criminal proceedings, which resulted in a violation of the requirements of Article 28 of the CCP in terms of conducting the pre-trial investigation within a reasonable time. The materials of the said criminal proceedings were found in the premises of the Bolgrad District Prosecutor’s Office.
Prosecutor Vasil Rusanzhyk admitted that he had committed violations and noted that these violations were caused by a heavy workload.
In particular, he said that in late 2018 or 2019 (he does not remember the exact date) he was summoned by the head of Izmail local prosecutor’s office and informed that criminal proceedings were found in his office. He was instructed by the head of the local prosecutor’s office to take the said materials to the Bolgrad branch of the Izmail local prosecutor’s office for further storage in the archive. In December 2021, while examining a request from the Rivne Regional Prosecutor’s Office, criminal proceedings were found in the archive of the Bolgrad District Prosecutor’s Office.
The PSCC decided to bring prosecutor Rusanzhyk to disciplinary responsibility and impose a disciplinary sanction in the form of a reprimand on him.
