The Oktyabrsky District Court of Bashkiria issued a verdict in the case of abuse of power when concluding state contracts to the former head of the capital construction department, the republic’s Minister of Construction, Ramzil Kucharbaev, and the ex-director of construction department No. 3 of the Federal Penitentiary Service Ruslan Valishin. This was reported in the press service of the regional Sledkom.
As the investigation and the court established, from 2017 to 2019, Kucharbaev, heading the capital construction department, without bidding, concluded 50 state contracts with the construction department No. 3 of the Federal Penitentiary Service for the construction of social infrastructure facilities – kindergartens, schools, cultural centers, treatment and engineering facilities, etc. At the same time the department of the Federal Penitentiary Service did not have the material and technical base to carry out the work and did not intend to carry it out. Therefore, Valishin, in collusion with Kucharbaev, subsequently entered into subcontracts for the performance of the entire scope of work with other firms without bidding at a reduced price. And the largest contracts in the amount of 450 million were transferred for execution to companies of acquaintances and friends of Kucharbaev.

“Thus, Federal State Unitary Enterprise US No. 3 of the Federal Penitentiary Service of Russia actually acted as an intermediary, having received more than 143 million rubles from the regional and federal budgets. As a result of the unlawful actions of the defendants, the competitive procedures provided for by law for the right to conclude contracts were grossly violated, which led to an unreasonable restriction of competition in an indefinite circle, ”the IC said in a statement.
The defendants pleaded not guilty. Their property was seized in the amount of 18 million rubles.
The court sentenced Ramzil Kucharbaev to six years in prison, and taking into account the earlier sentence in the case of the construction of treatment facilities in Kumertau, to nine years. Ruslan Valishin was sentenced to five years in prison in a penal colony. They were deprived of their rights to hold positions in the civil service for two and three years, respectively.
Dmitry Gorbunov, a partner at the law firm Rustam Kurmaev and Partners, noted that it would be difficult for the defendants to challenge the court’s decision.
“The right to appeal the verdict is guaranteed by law. However, considering the situation as a whole and on a large scale, it will be difficult for the party to defend its position due to previous judicial acts, since we are talking about quite significant abuses that entailed appropriate consequences. You may have to overcome some pre-judicial moments, ”he said.
