Tagansky Court of Moscow sentenced former head of United Financial Capital Bank (OFK-bank) Nikolai Gordeev To eight years in prison for fraud and embezzlement. This was reported to TASS on Monday by the press service of the Moscow prosecutor’s office.

“The Tagansky District Court of Moscow issued a guilty verdict in a criminal case against the Chairman of the Board of PJSC United Financial Capital (PJSC OFK Bank) Nikolai Gordeev. He was found guilty under part 4 of article 160 of the Criminal Code of the Russian Federation (embezzlement in an especially large size), part 4 of article 159 of the Criminal Code of the Russian Federation (fraud on an especially large scale). Taking into account the position of the state prosecutor, the court sentenced Nikolai Gordeev to 8 years in prison with a sentence to be served in a general regime correctional colony,” the press service said. They also added that the court deprived the former banker of the right to hold senior positions in government and local government for a period of three years.

As the court established, in 2016-2017 Gordeev was a member of an organized criminal group that acted in the interests of the co-owner of OFK-Bank Igor Chuyan. Its participants squandered 9.47 billion rubles belonging to the bank. To do this, fictitious agreements were concluded with companies controlled by Gordeev on the assignment of rights of claim under factoring agreements. With regard to Chuyan and a number of Gordeev’s accomplices, the cases were separated into a separate proceeding.

In addition, in 2017, Gordeev, realizing that PJSC “OFK Bank” and LLC “OFK-management” affiliated with the bank, are in a pre-bankrupt state, not intending to fulfill their obligations, entered into loan agreements with several citizens for a total of 690.6 million rubles. According to the court verdict, the former banker stole the money.

This is the second sentence against Gordeev. In the spring of 2022, the Meshchansky Court of Moscow found Gordeev guilty under Part 2 of Art. 201 of the Criminal Code of the Russian Federation (abuse of authority with grave consequences) and sentenced him to eight years in a strict regime colony with a fine of more than 10.5 billion rubles.

One of the main grounds for commuting the sentence was the convict’s repentance and his active assistance to the investigation.

As stated in court, Mr. Gordeev gave exhaustive testimony about the circumstances of the crimes described in the criminal case and the role of other participants in it. […] This time, Nikolai Gordeev was tried on charges of embezzlement (part 4 of article 160 of the Criminal Code of the Russian Federation) of 9.47 billion rubles. from funds of OFK-bank. […] It is worth noting that during the investigation of the second case, Nikolai Gordeev pleaded guilty and cooperated with the investigation, testifying against other participants in the crimes. […]

During the debate, the prosecutor asked to sentence Nikolai Gordeev under Art. 160 of the Criminal Code of the Russian Federation to nine years and six months in a general regime colony. The public prosecutor also requested the same term under Article 159, proposing to fine the convict 5 million rubles as an additional punishment. And in the end, by partial addition of punishments, taking into account the sentence previously passed to the banker, the prosecutor asked to sentence Nikolai Gordeev to 14 years and 6 months in a penal colony. However, the court decided otherwise. Taking into account the active repentance of the defendant and his assistance to the investigation, the presiding judge considered it possible to appoint Nikolai Gordeev a sentence significantly lower – eight years in a penal colony without a fine. In 2018, the Bank of Russia found signs of the withdrawal of assets in OFK-bank. According to the regulator, the negative capital of the bank then reached 17.4 billion rubles. Shortly thereafter, the credit institution’s license was revoked, and Gordeeva detained.
